COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 081044

 

Rezoning an area of approximately 2.83 acres generally located at 5236 Cherry Street from District R-4 to District PD/R-4, and approving a development plan for the same. (13857-PD-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0815, rezoning an area of approximately 2.83 acres generally located at 5236 Cherry Street from District R-4 (Low Apartments) to District PD/R-4 (Planned District/Low Apartments), said section to read as follows:

 

Section 80-11A0815. That an area legally described as:

 

Lot 4 and the south 15 feet of Lot 1, Block 3, Southwood Park, and Lot 1, except that part lying southwest of the following described line: Beginning at a point on the east line of said Lot 1, which is 50 feet northwesterly from extreme southeast corner of said Lot 1, and produced to a point in the westerly line of said Lot 1, which is 50 feet northeasterly measured along the westerly line of said Lot 1, from extreme southwest corner of said Lot 1, all in Block 9, Crestwood, both subdivisions in Kansas City, Jackson County, Missouri,

 

is hereby rezoned from District R-4 (Low Apartments) to District PD/R-4 (Planned District/Low Apartments), all as shown outlined on a map marked Section 80-11A0815, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1.                  That the developer secure permits to construct new, repair existing, or reconstruct curbs and gutters as necessary along all development street frontages in accordance with Chapters 56 and 64, Code of Ordinances, or submit a letter from a Missouri licensed civil engineer stating that the curbs and gutters are in a good state of repair and meet the requirements set forth in Chapters 56 and 64, Code of Ordinances, as required by the Development Services, prior to council approval of the development plan.

 

2.                  That the requirement for sidewalk installation be waived.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
