ORDINANCE NO. 080320

 

Terminating the Trinity-St. Marys Urban Renewal Plan for that area of approximately 20 acres generally bounded by 28th Street on the north, Main Street on the east, 31st Street on the south and Baltimore Street and Wyandotte Street on the west and consent to the termination of the plan and the release of the land use restrictions within the plan; and directing the City Clerk to record documents as necessary.

WHEREAS, by passage of Ordinance No. 32617, passed May 20, 1966, the City Council approved a general urban renewal plan for the Trinity-St. Marys Urban Renewal Project; and

WHEREAS, the Trinity-St. Marys Urban Renewal Plan was amended on June 26, 1967, by the passage of Ordinance No. 34261, and further amended on August 18, 1967, by the passage of Resolution No. 34261; and

WHEREAS, the Land Clearance for Redevelopment Authority of Kansas City, Missouri, did on November 26, 2003, adopt a Resolution No. 11-08-03 recommending approval of the Urban Renewal Area to allow for the termination of the plan and the subsequent release of the land use restrictions within the plan; and

WHEREAS, the City Plan Commission reviewed the amendment to the Trinity-St. Marys Urban Renewal Plan to allow for the termination of the plan and the subsequent release of the land use restrictions within the plan on April 20, 2000; and

WHEREAS, pursuant to Ordinance No. Committee Substitute 040590, passed on June 17, 2004, it was determined that it was desirable and in the public interest that the Trinity St. Marys Urban Renewal Plan be modified to allow for the termination of the plan and the Land Clearance for Redevelopment Authoritys subsequent release of the land use restrictions within the plan; and

WHEREAS, the Land Clearance for Redevelopment Authority of Kansas City, Missouri executed that certain Notice of Plan Termination and Release dated January 5, 2005, and recorded with the Jackson County Missouri Recorders Office on January 24, 2005, as Instrument 2005K0004564; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. The Council hereby consents to the Notice of Plan Termination and Release dated January 5, 2005, and recorded with the Jackson County Missouri Recorders Office on January 24, 2005, as Instrument 2005K0004564.

 

Section 2. That the Trinity-St. Marys Urban Renewal Plan shall be deemed terminated as to the property more particularly described in the Notice of Plan Termination and Release dated January 5, 2005, and recorded with the Jackson County Missouri Recorders Office on January 24, 2005, as Instrument 2005K0004564 (the Property).

 

Section 3. That all restrictions on the use of the Property that were set forth in the Trinity-St. Marys Urban Renewal Plan or set forth in other instruments by reference to the Trinity-St. Marys Urban Renewal Plan are hereby deemed released.

 

Section 4. That either the Director of City Development or the Director of Finance (or both) are hereby authorized to execute and deliver any and all documents necessary to effectuate the purposes of this Ordinance and the City Clerk is directed to record such documents with the appropriate governmental offices as necessary.
