RESOLUTION NO. 950700

 

Increasing the list of the City's federal legislative priorities by adding one new priority which opposes the proposed federal takings legislation.

 

WHEREAS, the Supreme Court has handed down several decisions which affirm a landowner's right to be compensated for governmental takings; and

 

WHEREAS, Congress is contemplating passage of a bill which would make government liable for compensating property owners for the loss of any proposed use of their property if that government prohibits the proposed use; and

 

WHEREAS, this legislation serves as a dangerous precedent for the states which could impose similar restrictions, costs and requirements on state and local governments and would affect local government decision on zoning and land use, business regulation, and affordable housing; and

 

WHEREAS, mechanisms already exist which protect the rights of all property owners and this legislation could severely limit the ability of local officials to adequately protect the health safety, and welfare of their residents; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

That the City Council of Kansas City hereby adds the following federal legislative priority to its list:

 

GENERAL LEGISLATION WITH NATION-WIDE IMPACT

 

13. Oppose legislation which alters the current methods by which government compensates a property owner when a taking occurs.
