SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 910102

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2360, rezoning an area of approximately 8.8 acres at the northeast corner of Blue Ridge Boulevard and 102nd Street from District R-1a (One-Family Dwelling - Medium Density) to District O (Office), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance is hereby amended by enacting a new section to be known as Section 65.010A2360, rezoning an area of approximately 8.8 acres at the northeast corner of Blue Ridge Boulevard and 102nd Street from District R-1a (one-family dwelling - medium density) to District O (office), said section to read as follows:

 

Section 65.010A2360. That an area legally described as:

 

The west 113 feet of the east 453 feet of Lot 25, RUSKIN ACRES, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

Lot 4, LAWSTOM ACRES, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

Tract 1: Lot 26, except that part in Blue Ridge Boulevard, RUSKIN ACRES, a subdivision in Kansas City, Jackson County, Missouri.

 

Tract II: Lot 25, lying northeasterly of relocated 102nd Street, except the east 453 feet thereof and except that part in Blue Ridge Boulevard, RUSKIN ACRES, a subdivision in Kansas City, Jackson County, Missouri.

 

Lot 27, RUSKIN ACRES, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

Lot 28, except that part thereof deeded for highway purposes, RUSKIN ACRES, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

The east 217 feet of Lot 25, except the east 108 feet of Lot 25, RUSKIN ACRES, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

The west 123 feet of the east 340 feet of Lot 25, RUSKIN ACRES, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

 

is hereby rezoned from District R-1a (one-family dwelling - medium density) to District O (office), all as shown outlined on a map marked Section 65.010A2360, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances, commonly known as the Subdivision

Regulations.

 

2. That the developer contribute to the I-435/470 Corridor Study Fund in the amount of $1.00 per square foot for

office space and $1.75 per square foot for medical office

space.

 

3. That the developer dedicate right of way on 102nd Street to provide 30 feet from centerline.

 

4. That the developer improve one-half of 102nd Street to collector standards with sidewalks.

 

5. That the developer construct sidewalks on the east side of Blue Ridge Boulevard along the property's frontage.

 

6. That the developer widen Blue Ridge Bouleard by 6 feet on each side to provide a southbound left turn lane into the

site.

 

A copy of said preliminary plan is on file in the Office of the City Clerk under Document No. 910102, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
