ORDINANCE NO. 100798

 

Authorizing the Director of Public Works to execute a Cooperative Agreement with the Tax Increment Financing Commission; estimating revenue in the Capital Improvements Sales Tax Fund; and appropriating $95,000.00 for the design of the Route 152 Trail.

 

WHEREAS, in Ordinance No. 990256, the Council accepted the recommendations of the Tax Increment Financing Commission of Kansas City (Commission) and approved the KCI Corridor Tax Increment Financing Plan (the Plan); and

 

WHEREAS, the Plan has been amended eight times with Ordinances 040618, 040619, 040620, 040621, 050107, 060326, 080211, and 090260; and

 

WHEREAS, during the course of the amendments, funding was identified for the design and construction of multi-purpose trails along Route 152 and I-29 (“T1”, “T2”, “T3”); and

 

WHEREAS, the portion of the Route 152 trail from Tiffany Springs Road to Ambassador Drive, T2, is under construction; and

 

WHEREAS, upon the completion of T2, the Commission will have approximately $95,000 in funding for the design and construction of the Route 152 Trail from Ambassador to Green Hills Road, T3; and

 

WHEREAS, the Second Council District with the approval of Committee Substitute for Ordinance 100692, As Amended, passed August 26, 2010, authorized funding for the design of the Route 152 Trail from Green Hills Road to Line Creek Parkway; and

 

WHEREAS, the Commission and City wish to complete both projects cooperatively and in partnership; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Public Works is authorized to execute a cooperative funding agreement with the Tax Increment Financing Commission for the purpose of providing for the design of the Route 152 Trail from Ambassador to Green Hills Road. The agreement is approved in substantial form as that on file in the office of the Director of Public Works, subject to the receipt of all required approvals.

 


Section 2. That the revenue in the following account is estimated in the following amount:

 

11-3090-890001-485380-89020083 Contribution from TIF Commission $95,000.00

 

Section 3. That the sum of $95,000.00 is appropriated from the Unappropriated Fund Balance of the Capital Improvement Fund Balance of the Capital Improvement Fund to the following account in the Capital Improvement Fund:

 

11-3090-898201-B-89020083 Route 152 Trails $95,000.00

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
