ORDINANCE NO. 100775

 

Condemning and taking private property interests for public use; for the construction, location and maintenance of N. Congress Avenue from the area of Missouri Highway 9 to NW 73rd Terrace; providing for the payment of just compensation therefore; authorizing continued negotiations by the Capital Project Office; consenting to the filing of the petition for condemnation by the City Attorney on behalf of the City; and authorizing the City Clerk to cause this ordinance to be recorded in the office of the Recorder of Deeds for Kansas City, Platte County, Missouri.

WHEREAS, the Council finds that private property interests must be condemned for the purpose of locating, relocating, constructing and maintaining streets, sewers, and necessary appurtenances, grades, slopes, and cutbacks in Kansas City, Platte County, Missouri; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. Property interests are hereby condemned and taken for public use in and upon the private lands hereinafter described, for Project Number 089008091.

Section 2. Said improvements shall be of the nature described and specified in, and shall be done in accordance with, the plans and specifications for Project Number 089008091 certified by the City Engineer under the supervision of the Director of Public Works, the same being on file in the Office of the Director of Public Works and being incorporated herein by reference.

Section 3. That the areas herein called Street Right-of-Way, Permanent, and Temporary Construction Easements shall be used by Kansas City as the permanent location of the, street, storm drainage, retaining wall, bicycle/pedestrian trail and grading improvements to be constructed therein including any necessary appurtenances to it; and Kansas City shall have the right to enter in or authorize the entry in and upon such right of way, and easements for the purpose of constructing, reconstructing, maintaining, operating and repairing said improvements or making connections thereto.

Section 4. The Temporary Easements shall be used by Kansas City or its authorized agents, servants, employees or contractors during the construction for utility construction work, the storage of materials, the operation of equipment, and the movement of a working force, as well as, grading and sloping, and the removal and replacement of temporary structures (such as storage sheds, mail boxes, etc.), fencing, trees and shrubbery, sidewalks and driveways.

Kansas City shall cause the surface of lands lying within said temporary easements to be restored to substantially the same physical condition that existed at the time Kansas City or its agents entered upon it, excluding necessary grade and slope improvements; said temporary easements shall terminate upon completion and acceptance of the improvements by the Director of Public Works. Temporary construction easements will exist for a period of three years after acquisition.

  Section 5. That the Street Right-of-Way, Permanent, and Temporary Construction Easements are hereby condemned and taken for public use and hereby described as follows:

 

Tract 1, Temporary Construction Easement

 

A parcel of land situated in a portion of Lot 11, Block 4, “NORTHRIDGE MEADOWS – FIRST PLAT “, a subdivision of land in the City of Kansas City, Platte County, Missouri, said parcel being more particularly described as follows:

Beginning at the Southeast corner of said Lot 11, said point being on the West right-of-way line of North Congress Avenue, as now established; thence North 89 degrees 44 minutes 09 seconds West 18.91 feet along the South line of said Lot 11; thence North 42 degrees 42 minutes 10 seconds East 27.72 feet, to a point on said West right-of-way line, said point being on a non-tangent curve concave to the West having a radius of 120.23 feet; thence Southerly 7.03 feet, along said West right-of-way line and said curve to the right having a chord bearing of South 01 degrees 24 minutes 42 seconds East 7.03 feet; thence South 00 degrees 15 minutes 51 seconds West 13.43 feet, along said West right-of-way line, to the “point of beginning “ of the parcel herein described, containing 195 square feet or 0.0045 acres, more or less, except that part lying in existing utility easements.

Commencing at the Northwest corner of the Northeast Quarter of said Section 24; Thence South 89 degrees 45 minutes 22 seconds East 14.00 feet, along the North line of the Northeast Quarter of said Section 24, to a point being 4.00 feet East of and at right angles to the East right-of-way line of North Congress Avenue, as now established, said point also being the “true point of beginning “; thence South 89 degrees 45 minutes 22 seconds East 11.95 feet along said North line; thence South 00 degrees 38 minutes 22 seconds East 60.96 feet; thence South 63 degrees 21 minutes 44 seconds East 34.21 feet; thence South 00 degrees 10 minutes 15 seconds West 21.11 feet; thence South 59 degrees 47 minutes 25 seconds West 39.16 feet; thence South 06 degrees 26 minutes 21 seconds West 23.23 feet; thence South 52 degrees 45 minutes 46 seconds East 28.73 feet; thence South 01 degrees 10 minutes 08 seconds East 7.50 to a point being on the South line of a certain tract of land conveyed by Trustee minutes s Deed recorded in Book 1111 at Page 585; thence North 89 degrees 45 minutes 22 seconds West 30.40 feet, along said South line, to a point being 4.00 feet East of and at right angles to said East right-of-way line; thence North 00 degrees 14 minutes 06 seconds East 165.00 feet, along a line 4.00 feet East of and parallel with said East right-of-way line, to the “true point of beginning “ of the tract herein described, containing 3,382 square feet or 0.0776 acres, more or less, except that part lying in existing utility easements.

Section 6. That just compensation for the property taken shall be assessed and paid according to law; and the proceedings to determine compensation shall be prosecuted in one or more suits in the Circuit Court of Platte County, Missouri, pursuant to the provisions of Chapter 523 of the Revised Statutes of Missouri, as supplemented or amended by Section 86.01 to 86.10 of the Rules of Civil Procedure. Payment of compensation shall be made by Kansas City from funds appropriated for such purposes.

Section 7. That pending the acquisition of said lands by condemnation, the Director of the Public Works is hereby authorized to purchase said land out of funds appropriated or to be appropriated as aforesaid, and if any tracts be so acquired by purchase, the City Attorney is authorized to withdraw same from condemnation proceedings.

Section 8. That said tracts and interests be condemned and conveyed to Kansas City, Missouri.

Section 9. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance to be recorded in the office of the Recorder of Deeds for Kansas City, Platte County, Missouri.
