ORDINANCE NO. 911427

Approving the Third Amendment to the Development Plan submitted by Forty-Sixth and Madison Redevelopment Corporation, authorizing the Director of Finance to enter into a Third Supplemental Contract between the City and Forty-Sixth and Madison Redevelopment Corporation.

WHEREAS, the Forty-Sixth and Madison Redevelopment Corporation, an urban redevelopment corporation in Missouri, organized under and pursuant to the Urban Redevelopment Corporations Act of 1945, as amended, did on March 30, 1984, file with the City Clerk an application for approval of a development plan which was approved by the City Council by Ordinance No. 56747, passed July 26, 1984; and

WHEREAS, the Forty-Sixth and Madison Redevelopment Corporation did file its First Amendment to the Development Plan which was approved by Committee Substitute for Ordinance No. 62950, passed November 17, 1988; and

WHEREAS, the Forty-Sixth and Madison Redevelopment Corporation did file its Second Amendment to the Development Plan which was approved by Ordinance No. 65159, passed February 22, 1990; and

WHEREAS, the Forty-Sixth and Madison Redevelopment Corporation did file its Third Amendment to the Development Plan on April 12, 1991; and

WHEREAS, legal notice of a public hearing on the proposed Third Amendment to the Development Plan was published on May 6, 1991; and

WHEREAS, pursuant to said public notice, a public hearing in which all interested parties were provided an opportunity to offer testimony was held on May 21, 1991; and

WHEREAS, the City Plan Commission made an independent study and investigation of the proposed Third Amendment to the Development Plan and did recommend approval of said Third Amendment to the Development Plan and said City Plan Commission has filed with the City Clerk a report recommending approval of said proposed amendment to the Development Plan, said report being attached hereto as Exhibit "A", and is incorporated herein by reference; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the application for approval of a Third Amendment to the Development Plan, by Forty-Sixth and Madison Redevelopment Corporation, a copy of which is on file in the office of the City Clerk under Document No. 911427 and which is incorporated herein by reference, is approved as a Third Amendment to the Development Plan as originally approved by Ordinance No. 56747, passed July 26, 1984, and as amended by Committee Substitute for Ordinance No. 62950, passed November 17, 1988, and as further amended by Ordinance No. 65159, passed February 22, 1990.

Section 2. That the Council hereby finds and declares that good cause has been shown for the approval of said Third Amendment to the Development Plan of Forty-Sixth and Madison Redevelopment Corporation and that the findings and declarations made by the Council in Section 2 of Ordinance No. 56747, with respect to the Development Plan of Forty-Sixth and Madison Redevelopment Corporation, have not been affected by the amendment thereto and equally apply to said Development Plan, as amended.

Section 3. That the Council hereby finds and determines that the public convenience and necessity will be served by the Development Plan, as amended.

Section 4. That the Director of Finance be, and he is hereby, authorized and directed on behalf of the City to enter into a Third Supplementary Contract with the Forty-Sixth and Madison Redevelopment Corporation, a copy of which is attached hereto as Exhibit "B", and which is hereby incorporated herein by reference.
