RESOLUTION NO. 080550

 

Directing the City Attorney to assist the Risk Management Committee with the development of proposed ordinance revisions or rules and regulations relating to seeking contribution from City officials, officers, employees and volunteers found to have committed discriminatory acts including retaliation.

 

WHEREAS, the Council recognizes the importance of a providing its employees with a workplace free of discrimination; and

 

WHEREAS, the Council recognizes the importance of the City conducting its activities in a manner free of discrimination; and

WHEREAS, the Council recognizes that the City has claims of discrimination asserted against it from time to time grounded on assertions that a City official, officer and employee committed a discriminatory or retaliatory act; and

 

WHEREAS, the Council recognizes that the City, from time to time, the payment of City funds from its legal expense fund is necessitated to pay for the settlement of such claims or to satisfy judgments entered on such claims; and

 

WHEREAS, Section 2-1686, Code of Ordinances, empowers the Risk Management Committee with the administration of this legal expense fund and with the power to enact certain rules and regulations related to the administration of the legal expense fund; NOW, THEREFORE

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Attorney is hereby directed to assist the Risk Management Committee in developing proposed ordinance revisions or proposed rules or regulations that will define a process and establish standards for the determination of when contribution will be sought from a City official, officer, employee or volunteer for the Citys payment of a settlement or judgment arising out of a claim or lawsuit in which it is alleged, or judicially determined, that an unlawful discriminatory act was committed by that City official, officer , employee or volunteer.

 

Section 2. That the City Attorney is to report back to the Council on the development of such proposed ordinance revisions or proposed rules or regulations within 60 days of the passage of this resolution.
