Approving the preliminary plat of 46 Jefferson on a .976 acre tract of land generally located at the northwest corner of 46th Street and Jefferson. (SD 1237)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of 46 Jefferson on an approximately .976 acre tract of land generally located at the northwest corner of 46th Street and Jefferson, and more specifically described as follows:

 

Lots 1, 2, 3 and 4, Elmore Addition, and also the East 160 feet of Lot 10, HOME PLACE, both Elmore Addition and Home Place being subdivisions in Kansas City, Jackson County, Missouri.

 

Being more particularly described as follows: Beginning at the NE Corner of Lot 1, Elmore Addition; thence along the Westerly Right-of-Way line of Jefferson Street and also the Easterly line of Lots 1 thru 4, Elmore Addition S0223'00"W a distance of 225.00 feet to the SE corner of Lot 4, Elmore Addition; thence along the Northerly Right-of-Way line of 46th Street and also the Southerly line of Lot 4, Elmore Addition S8737'00"E a distance of 109.00 feet to the SW corner of Lot 4, Elmore Addition; thence along the Westerly Line of Lots 2 thru 4 , Elmore Addition and also the Easterly line of Lot 11, Home Place N0223'00"E a distance of 112.50 feet to the SE corner of Lot 10, Home Place; thence along the Southerly line of Lot 10, Home Place S8737'00"E a distance of 160.00 feet to a point being 160.00 feet West of the SE corner of said Lot 10, Home Place; thence along a line parallel with the Easterly line of Lot 10, Home Place N0223'00"E a distance of 112.50 feet to a point on the Northerly line of said Lot 10 being 160.00 feet West of the NE corner of Lot 10, Home Place; thence along the Northerly line Lot 10, Home Place and also the Northerly line of Lot 1, Elmore Addition N8737'00"W a distance of 269.00 feet to the NE corner of Lot 1, Elmore Addition said point being the point of beginning, containing 0.976 acres, more or less.

 

is hereby approved, subject to the following conditions:

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, commonly known as the Subdivision Regulations.

2. That the developer secure permits to repair alley, sidewalks, curbs, and gutters as necessary along all development frontages as required by the Department of Public Works in accordance with Chapters 56 and 64, Code of Ordinances, or submit a letter from a Missouri Licensed Civil Engineer stating that the alleys, sidewalks, curb and gutters are in a good state of repair and meet the requirements set forth in Chapters 56 and 64 of the Code of Ordinances, prior to recording of the plat.

3. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of common elements and private open space tracts.

4. That the developer submit a street tree planting plan as part of the final plat, secure the approval of the City Forester for street trees planted on right-of-way in front of residential lots (with a copy to be submitted to the City Development Department staff), and agree to plant in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
