ORDINANCE NO. 060368

 

Approving an amendment to a previously approved development plan in District M-1p on a 17.67 acre tract of land generally located at the northwest corner of 108th Street and Missouri State Highway 291. (6093-P-18)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District M-1p (Light Industry/Limited District) on a 17.67 acre tract of land generally located at the northwest corner of 108th Street and Missouri State Highway 291, and more specifically described as follows:

 

All of Lots 1, 2, 3, 4, 5, 6 and 7, Pioneer Industrial Park-I, a subdivision in Kansas City, Clay County, Missouri, according to the recorded Plat thereof

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, commonly known as the Subdivision Regulations.

 

2.                  That the developer submit new or update the previously approved macro storm drainage study for the overall development to address the development amendments along with a detailed micro study for approval prior to approval of the next plat and make necessary improvements as required by Development Services.

 

3. That the developer submit plans for grading and siltation and erosion control to Development Services for approval prior to beginning any construction activities.

 

4. That the developer relocate existing water mains and provide exclusive easements as required by the Water Services Department.

 

5. That the developer extend water mains as required by the Water Services

Department.

 

6. That the developer dedicate additional right of way for N.E. 108th Street for a primary arterial with a bike path, as required by Development Services so as to provide a total of 56 feet of right of way as measured from the centerline of N.E. 108th Street on the next plat.

 

7. That the developer dedicate additional right of way for N.E. Cookingham Road for a primary arterial with a bike path, as required by Development Services so as to provide a total of 66 feet of right of way as measured from the centerline of N.E.Cookingham Road on the next plat.

 

8. That the developer make the following street improvements: (a) restripe N.E. 108th Street at its intersection with Missouri State Highway 291 to provide for a second eastbound turn lane to allow for exclusive left-turn and right-turn lanes; and (b) make minor modifications to the existing temporary signal at the intersection of Missouri State Highway 291 and Stark Avenue, which modifications shall consist of adding the necessary appurtenances to make the temporary signal functional for the 4-way intersection (upon the construction of the Tract A access drive at Highway 291).

 

9. That the developer provide for fire protection as required by the Fire Department.

 

10. That the developer secure permits to construct or reconstruct existing sidewalks, curb, gutter, storm sewers, and streetlights as necessary along all development street frontages, as required by Development Services, prior to recording the next plat.

 

11. That any relocated streetlights be integrated into existing street light system as required by Development Services and the Missouri Department of Transportation along State frontages.

 

12. That the developer extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by Development Services.

 

13. That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

14. That the developer secure the approval of the Missouri Department of

Transportation prior to working in any State right of way.

 

15. That the developer provide for cross-access easements between lots on the final plat as shown on the preliminary plan.

 

16. That the developer receive the approval of the Missouri Department of Transportation for access onto N.E. L.P. Cookingham Drive (Missouri Highway 291).

17. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, grading, signage (which plans shall be consistent with the landscaping, grading and signage shown on the approved development plan amendment), building elevations and a photometric study showing zero footcandles at the property lines and recessed or flush lighting under any gas canopy, prior to the issuance of any building permits for each phase of the development. The landscaping for the final plan shall consist of the landscaping that is shown on the approved development plan amendment, which consists of a 4 feet in height berm to be installed along the frontage of Missouri Highway 291 of Lot 5. No berm, however, shall be required on Lots 1 and 2 or Tracts C and D along the frontage of Missouri Highway 291 or along any of the lots along the frontage of N.E. 108th Street.

 

A copy of said amendment is on file in the office of the City Clerk with this Ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
