ORDINANCE NO. 070044

 

Accepting various Warranty Deeds, conveying to the City of Kansas City, Missouri, certain properties in Clay County, Missouri, all for public use, for NE 96th Street TIF Phase 3 improvements; establishing grades on public ways; accepting various easements; and authorizing the City Clerk to file this ordinance and attached documents.

WHEREAS said property shall be used for street and other public purposes as a part of NE 96th Street, together with easements in remaining lands on the abutting property along and adjacent to said streets, where required for the location, construction, and maintenance of an embankment or for sloping the sides of cuts back to construct and maintain said street at the established grade; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the General Warranty Deed by and between Hunt Midwest Real Estate Development, Inc. conveying property to the City of Kansas City, Missouri, for streets and other public purposes for NE 96th Street TIF Phase 3, a true copy attached hereto, was recorded on March 3, 2005, at 08:05:58 a.m., Instrument No. 2005009214 in Book 4923 on page 97, is hereby accepted. The property is legally described as follows:

A tract of land in the Southeast Quarter of Section 34, Township 52, Range 32, Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the Southeast corner of said Southeast Quarter; thence North 03047 East along the East line of said Southeast Quarter, 147.14 feet; thence North 892913 West, 965.19 feet to the True Point of Beginning of the tract to be herein described; thence Westerly on a curve to the right, having an initial tangent bearing of South 880125 West, a radius of 1282.00 feet, an arc distance of 42.91 feet; thence South 895629 West, 209.70 feet; thence North 00331 West, 62.00 feet; thence North 895629 East, 62.96 feet; thence South 831257 East, 100.72 feet; thence North 895629 East, 46.75 feet; thence Easterly on a curve to the left, tangent to the last described course, having a radius of 1232.00 feet, an arc distance of 44.60 feet; thence South 015245 West, 50.12 feet to the True Point of Beginning. Containing 0.32 acres (14,028 square feet), more or less.

Section 2. That the General Warranty Deed by and between Hunt Midwest Real Estate Development, Inc. conveying property to the City of Kansas City, Missouri, for streets and other public purposes for NE 96th Street TIF Phase 3, a true copy attached hereto, was recorded on May 19, 2006, at 02:17:53 p.m., Instrument No. 2006021134 in Book 5378 on page 14, is hereby accepted. The property is legally described as follows:

A tract of land in the Southeast Quarter and the Southwest Quarter of Section 34, Township 52, Range 32, Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the Southwest corner of said Southeast Quarter; thence North 03832 East along the West line of said Southeast Quarter, 128.78 feet to the True Point of Beginning of the tract to be herein described; thence North 885531 West, 111.74 feet; thence North 010429 East, 64.00 feet; thence South 885531 East, 8.19 feet; thence South 820457 East, 117.50 feet; thence South 885531 East, 243.46 feet; thence Easterly on a curve to the left, tangent to the last described course, having a radius of 9950.00 feet, an arc distance of 196.83 feet; thence North 895629 East, 823.23 feet; thence South 00331 East, 50.00 feet; thence South 895629 East, 823.23 feet; thence Westerly on a curve to the right, tangent to the last described course, having a radius of 10000.00 feet, an arc distance of 197.83 feet; thence North 885531 West, 256.57 feet to the True Point of Beginning. Containing 1.62 acres (70,375 sq. ft.), more or less.

Section 3. That the Special Warranty Deed by and between Nancy R. Botham conveying property to the City of Kansas City, Missouri, for streets and other public purposes for NE 96th Street TIF Phase 3, a true copy attached hereto, was recorded on December 14, 2006, at 08:19:20 a.m., Instrument No. 2006054590 in Book 5578 on page 102, is hereby accepted. The property is legally described as follows:

A tract of land in the Southeast Quarter and the Southwest Quarter of Section 34, Township 52, Range 32, Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the Southeast corner of said Southeast Quarter; thence North 893149 West along the South line of said Southeast Quarter, 111.39 feet; thence North 891808 West along said South line, 697.25 feet; thence North 04152 East, 111.07 feet to the True Point of Beginning of the tract to be herein described; thence Westerly on a curve to the right, having an initial tangent bearing of South 812005 West, a radius of 1332.00 feet, an arc distance of 200.09 feet; thence South 895629 West, 1188.94 feet; thence Westerly on a curve to the right, tangent to the last described course, having a radius of 10050.00 feet, an arc distance of 198.81 feet; thence North 885531 West, 327.84 feet; thence North 00110 West, 15.00 feet to a point on the Southerly right-of-way line of NE 96th Street, as now established; thence South 885531 East along said Southerly line, 427.38 feet; thence North 895629 East along said Southerly line, 581.95 feet; thence North 870444 East along said Southerly line, 100.12 feet; thence North 895629 East along said Southerly line, 100.00 feet; thence South 871146 East along said Southerly line, 100.12 feet; thence North 895629 East along said Southerly line, 605.59 feet to the True Point of Beginning. Containing 0.66 acres (28,697 square feet), more or less.

Section 4. That the grades of the streets and other public ways set out on the approved NE 96th Street TIF Phase 3, Street and Storm Sewer plans (File No. 2006-044), herein accepted, are hereby established at the top of curb, locating and defining the grade points which shall be connected by true planes or vertical curves between such adjacent grade points, the elevations of which are therein given, in feet above the City Directrix.

Section 5. That various easements in Kansas City, Clay County, executed by the following persons, and which appear of record as the instrument number, and respective book and page numbers are hereby accepted for the purposes stated thereof:

Section 6. That the City Clerk is hereby directed to file copies of this ordinance, together with the documents described herein and all other relevant documents together with the Warranty Deeds, in the Office of the Recorder of Deeds of Clay County, Missouri._____________________________________________
