COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 960501

 

Approving the preliminary plat of Wind Tree Subdivision on a 30.9 acre tract of land located north of Englewood Road about one quarter mile west of U. S. Highway 169. (SD 0725)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Wind Tree Subdivision on a 30.9 acre tract of land located north of Englewood Road about one quarter mile west of U. S. Highway 169, and more specifically described as follows:

 

All that part of the Fractional SW 1/4 of Section 27, Township 51, Range 33, Kansas City, Clay County, Missouri, being described as follows: Beginning at a point on the east line of said Fractional SW 1/4, said point being 35.00 feet north of the southeast corner of said Fractional SW 1/4, said point being also on the north right of way line of Englewood Road, as now established; thence North 89 28'56" West, parallel with the south line of said Fractional SW 1/4 and along said right of way line, 635.00 feet; thence North 00 31'43" East, parallel with the east line of said Fractional SW 1/4, 660.00 feet; thence North 89 28'56" West, parallel with the south line of said Fractional SW 1/4, 660.00 feet; thence South 00 31'43" West, parallel with the east line of said Fractional SW 1/4, 660.00 feet to the north right of way line of said Englewood Road; thence North 89 28'56" West, along said line, 437.60 feet to the west line of said Fractional SW 1/4; thence North 00 08'12" West, along said line, 1023.72 feet to a line established by a boundary line agreement recorded in Book 1051 at page 980 in the Recorder's Office of Clay County, Missouri; thence South 89 42'25" East, along said line, 1742.50 feet to the east line of said Fractional SW 1/4; thence South 00 31'43" West, along said east line, 1030.48 feet to the point of beginning. Containing approximately 1,348,000 square feet or 30.9 acres.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations and label the landscape easement on lots

backing onto Englewood Road right of way with the note "This strip reserved for the

planting of trees or shrubs by the owner or developer; the building of structures

hereon is prohibited."

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval for the entire development and that improvements be made as required by

the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to the commencement of any construction

activities.

 

4. That the developer improve the north half of Englewood Road (N.W. 56th Street) to parkway standards.

 

5. That the developer dedicate right of way to insure 75 feet as measured from the centerline of Englewood Road.

 

6. That the developer grant a Noise and Aviation Easement to the City.

 

7. That the developer secure the approval of the Street Naming Committee for all street names prior to submittal of the first final plat.

 

8. That the developer install hard surface roads and fire protection prior to construction beyond foundations.

 

9. That the developer provide for fire protection as required by the Fire Department.

 

10. That the developer extend water mains as required by the Water Services Department.

 

11. That the developer obtain a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area for the entire development exceeds five

acres.

 

12. That the developer contribute $14,781.47 in lieu of parkland dedication for 98 single family lots in satisfaction of Section 66-128 of the Subdivision Regulations.

 

13. That the developer submit a street tree planting plan with the final plat and secure the approval of the City Forester for all street trees planted on right of way.

 

14. That the developer obtain permits and bonding to insure the construction of the street extension west and south to join with the N.W. Englewood Road west access point

within two years of the date of City Council approval of the Phase 2 final plat.

 

15. That the developer construct temporary cul-de-sacs as required by the City Engineer's Office.

 

16. That the developer comply with all KCIA zoning requirements.

 

A copy of said preliminary plat is on file in the office of the City Clerk under Document No. 960501, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
