RESOLUTION NO. [R-2012-01178]

 

Expressing the Mayor and Council’s support for the President and the Congress of the United States to reauthorize the Federal Assault Weapons Ban; and directing the City Clerk to send this Resolution to our Congressional Representatives.

 

WHEREAS, the Mayor and City Council grieve for the young children and caring adults who were so senselessly and brutally gunned down on December 14, 2012, in Newtown, Connecticut as well as other victims of gun violence; and

 

WHEREAS, assault weapons are a class of semi-automatic firearms designed with military features that allow them to spray large amounts of fire quickly and accurately; they are distinguishable from standard sporting firearms by features such as pistol grips and the ability to accept a detachable magazine; and

 

WHEREAS, military style, semi-automatic weapons represent an unreasonable risk to the Nation’s law enforcement personnel and the general public; and

 

WHEREAS, assault weapons are frequently used in mass shootings, including the recent tragedy at Sandy Hook Elementary School as well as the Aurora, Colorado shooting; both involving semi-automatic weapons that would have been prohibited under the Federal Assault Weapons Ban, if it had been in effect, but instead expired in 2004; and

 

WHEREAS, President Obama in his speech of December 18, 2012, said that action on gun violence is needed and this effort will require the support of the American people; and

 

WHEREAS, through Section 21.750, Revised Statutes of Missouri, the State of Missouri forbids, with limited exceptions not relevant to a ban on the possession of assault weapons by citizens, any city or county from adopting an ordinance “touching in any way firearms, components, ammunition and supplies” including “the sale, purchase, purchase delay, transfer, ownership, use, keeping, possession, bearing, transportation, licensing, permit, registration, [or] taxation” of any gun;” and

 

WHEREAS, because the State of Missouri does not allow local regulation the City must look to the State and Federal government for meaningful regulation; and

 

WHEREAS, the United States Conference of Mayors have called on Congress to enact legislation being prepared by Senator Dianne Feinstein and others that will ban assault weapons and high-capacity magazines, and to pass legislation that will strengthen the national background check system and eliminate loopholes in it; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council of Kansas City adds its voice to the growing crescendo in support of Federal legislation to ban assault weapons and strengthen the background checks for those who seek to obtain firearms.

 

Section 2. That the City Clerk shall provide copies of this Resolution to Senator Claire McCaskill, Senator Roy Blunt, Congressman Sam Graves, and Congressman Emanuel Cleaver II.
