Rezoning an area of approximately
22.5 acres located at the northwest corner of 23rd Street and Manchester Avenue from District M-2a to District URD and approving a development plan for
the same. (13400-URD)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly
known as the Zoning Ordinance, is hereby amended by enacting a new section to
be known as Section 80-11A0659, rezoning an area of approximately approximately
22.5 acres located at the northwest corner of 23rd Street and Manchester Avenue from District M-2a (Heavy Industry) to District URD (Urban Redevelopment
District),said section to read as follows:
Section 80-11A0659. That an area
legally described as:
Tax Parcel No.
27-420-08-01-0-00-000: Part of the Northwest 1/4 of Section 7, Township
49, Range 32, in Kansas City, Jackson County, Missouri, being more particularly
described as follows: Commencing at the Southeast corner of said 1/4 section;
thence North 86 Degrees 43 Minutes 39 Seconds West along the South line of said
section, a distance of 1859.74 feet; thence deflecting 90 Degrees 00 Minutes 00
Seconds right, a distance of 456.06 feet to the point of intersection of the
Easterly Right-of-Way line of the Union Pacific Railroad; as now established
and the Westerly Right-of-Way line of Kansas City Southern Railroad, as now
established said point also being the point of beginning of the tract of land
to be herein described; thence North 11 Degrees 44 Minutes 59 Seconds West
along said Easterly Right-of-Way line and the Northerly prolongation thereof, a
distance of 1370 feet, more or less, to the centerline of the Big Blue River
Channel; thence Northeasterly along the meandering of the centerline of the Big
Blue River, to a point on the Northerly prolongation of the Westerly
Right-of-Way line of the Kansas City Southern Railroad, as now established;
thence South 2 Degrees 04 Minutes 14 Seconds West along said Westerly
Right-of-Way line and its Northerly prolongation, a distance of 750 feet, more
or less; thence continuing along said Westerly Right-of-Way line and a curve to
the left tangent to the last described course, having a radius of 2904.43 feet
and a central angle of 13 Degrees 49 Minutes 13 Seconds, an arc distance of
700.58 feet to the point of beginning.

49, Range 32, in Kansas City, Jackson County, Missouri, being more particularly
described as follows: Commencing at the Southeast corner of said 1/4 Section;
thence North 86 Degrees 43 Minutes 39 Seconds West along the South line of said
Section, a distance of 1398.59 feet; thence deflecting 90 Degrees 00 Minutes 00
Seconds right from the last described course, a distance of 114.97 feet to the
point of intersection of the North Right-of-Way line of 23rd Street, as now established
and the West Right-of-Way line of Manchester Avenue, as now established said
point also being the point of beginning of the tract of land to be herein
described; thence North 86 Degrees 41 Minutes 15 Seconds West along said North
Right-of-Way line of 23rd Street a distance of 301.34 feet to a point on the
Easterly Right-of-Way line of the Kansas City Southern Railroad, as now
established; thence North 11 Degrees 44 Minutes 59 Seconds West along said
Easterly Right-of-Way line, a distance of 370.65 feet; thence continuing along
said Easterly Right-of-Way line and a curve to the right tangent to the last
described course having a radius of 2838.43 feet and a central angle of 13
Degrees 49 Minutes 13 Seconds, an arc distance of 684.66 feet; thence North 2
Degrees 04 Minutes 14 Seconds East continuing along said Easterly Right-of-Way
line and the Northerly prolongation thereof, a distance of 750 feet, more or
less, to a point in the centerline of the Big Blue River; thence Northeasterly
along the meandering of the centerline of the Big Blue River, to a point on the
Northerly prolongation of the West Right-of-Way line of Manchester Avenue, as
now established; thence South 2 Degrees 04 Minutes 14 Seconds West along said
West Right-of-Way line and its Northerly prolongation of the centerline of the
Big Blue River, a distance of 1800 feet, more or less, to the point of
beginning.
is hereby rezoned from District
M-2a (Heavy Industry) to District URD (Urban Redevelopment District),all as
shown outlined on a map marked Section 80-11A0659, which is attached hereto and
made a part hereof, and which is hereby adopted as a part of an amendment to
the zoning maps constituting a part of said chapter and as an amendment to
Section 80-11 thereof.
Section B. That
a development plan for the area legally described above is hereby approved,
subject to the following conditions:
1. That the developer shall cause the area to be platted and
processed in accordance with Chapter 66, Code of Ordinances of the City of
Kansas City, Missouri, commonly known as the Subdivision Regulations.
2. That the developer submit a macro/micro storm drainage study
to Development Services for approval for the entire development when the first
plat is submitted, and that the developer construct any improvements as
required by Development Services.
3 That the developer dedicate additional right of way for a
primary arterial as required by the Department of Public Works so as to provide
a minimum of 50 feet of right of way as measured from the centerline of 23rd Street.
4. That the developer shall subordinate to the City all private
interest in the area of any right-of-way dedication as required by the
Department of Public Works, and that the developer shall be responsible for all
costs associated with subordination activities.
5. That the developer secure permits to construct or
reconstruct existing sidewalks, curb, gutter, storm sewers, and streetlights as
necessary along all development street frontages, as required by Development
Services, prior to recording the plat.
6. That the developer submit plans for grading, siltation, and
erosion control to Development Services for approval and permitting prior to
beginning any construction activities.
7. That the developer secure a land disturbance permit from
Development Services prior to beginning any construction, grading, clearing, or
grubbing activities, if the disturbed area exceeds one acre.
8. That the developer extend sanitary sewers to ensure
individual service is provided to all proposed lots and determine adequacy as
required by the Department of Public Works.
9. That the developer provide a storm water conveyance system to
serve all proposed lots within the development and determine adequacy as
required by the Department of Public Works.
10. That the developer obtain a floodplain certificate from
Development Services prior to beginning any construction activities with the
floodplain.
11. That the limits of the 100-year floodplain be shown on the
final plat.
12. That the lowest opening or elevation or Minimum Low Opening
(MLO) of any structure on each lot that abuts a 100-year floodplain area be
shown on the final plat.
13. That the developer submit covenants, conditions and
restrictions to the Law Department for approval for the maintenance of private
open space and enter into a covenant agreement for the maintenance of any
stormwater detention area tracts.
14. That the developer submit a street tree planting plan as part
of the final plat, secure the approval of the City Forester for street trees
planted on right-of-way (with a copy to be submitted to the City Development
Department staff), and agree to plant in conformance with the plan approved by
the City Forester. The plan shall include size, type, species, and placement
of trees.
15. That the developer receive the approval of the Board of Zoning
Adjustment as necessary for any maneuvering in the right of way.
16. That the developer submit a final plan to the Director of City
Development for approval, including detailed information on landscaping per
staff approval, signage (including elevations), and building elevations.
A copy of said development plan
is on file in the office of the City Clerk with this ordinance and is made a
part hereof.
Section C. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
