ORDINANCE NO. 010472

 

Approving the preliminary plat of Butler World Headquarters on approximately a 16 acre tract of land generally located at the northwest corner of Genessee Street and American Royal Drive. (SD 0953)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Butler World Headquarters on approximately a 16 acre tract of land generally located at the northwest corner of Genessee Street and American Royal Drive, and more specifically described as follows:

 

All of Lots 1 thru 13, inclusive, part of Lots 14 and 15 and all of Lots 16 thru 30, inclusive, in Block 3; all of Blocks 4, 5 and 6; part of Lot 12 and all of Lots 13 thru 16, inclusive, and part of Lot 21 and all of Lots 17 thru 20, inclusive, in Block 9; part of Lot 12 and all of Lots 13 thru 16, inclusive, and part of Lot 21 and all of Lots 17 thru 20, inclusive, in Block 10; together with all or portions of vacated alleys and streets abutting all of the above mentioned lots, all in Skiles and Westerns Addition, a subdivision of land being a part of Lot 2 in the Southwest Quarter of Fractional Section 6, Township 49 North, Range 33 West of the Fifth Principal Meridian; and also a portion of the Northwest Quarter of Fractional Section 7, Township 49 North, Range 33 West of the Fifth Principal Meridian all in Kansas City, Jackson County, Missouri, according to an official plat of said land filed in the District Land Office in St. Louis, Missouri, dated July 31, 1862, being more particularly described as follows:

 

NOTE: Bearings stated in the following description are oriented to Grid North, Missouri State Plane Coordinate System, West Zone, North American Datum 1983.

 

Beginning at the southwest corner of said Fractional Section 6, said point being on the Kansas/Missouri state line; thence North 00E17'41" East, 1016.21 feet, along the west line of said Fractional Section 6 and said state line, to the southwest corner of Gateway 2000 - Missouri, a subdivision of land; thence South 87E58'19" East, 612.62 feet, along the south line of said subdivision, to a point on the west right of way line of Genessee Street, as now established; thence South 01E52'50" West, 952.22 feet, along said west right of way line, to the most northerly corner of a tract of land conveyed to the City of Kansas City, Missouri, by a warranty deed recorded under Document No. K-244810 in Book K-558 at page 1499 and accepted by Kansas City under Ordinance No. 43861 filed November 4, 1974 under Document No. K-244813 in Book K-558 at page 1506; thence southerly 24.38 feet, along the northerly line of said tract of land, being a curve to the right, tangent to the last described course and having a radius of 79.04 feet; thence southerly 93.05 feet, along said northerly line being a curve to the right, having a common tangent with the last described curve and a radius of 110.00 feet; thence South 02E10'00" West (North 1E53'22" East by deed) 6.45 feet, along said northerly line; thence North 87E50'16" West (South 88E06'34"


East by deed) 37.38 feet, along said northerly line; thence South 79E41'38" West (South 79E25'00" West by deed) 180.77 feet, along said northerly line and along the southerly line of a tract of land conveyed by warranty deed recorded under Document No. 244814 in Book K-558 at page 1508 and the northerly right of way line of American Royal Drive, as now established, to the beginning of a curve concave to the southeast having a radius of 377.00 feet; thence southerly 471.01 feet, along said northerly right of way line and said curve to the left and tangent with the last described course, to a point on the west line of said Fractional Section 7 and the Kansas/Missouri state line; thence North 00E17'16" East, 401.35 feet, along said west line and said state line, to the northwest corner of said Fractional Section 7 and the point of beginning of the tract herein described, containing 669,612 square feet or 15.3722 acres, more or less. Subject to all easements and restrictions of record.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer dedicate additional right of way for State Line Road as required by the Department of Public Works so as to provide a total of 60 feet of right of way for State Line Road.

 

7. That the developer construct State Line Road to collector street standards with a total right of way width of 60 feet as required by the Department of Public Works, including construction of curbs, gutters and sidewalks and installation of streetlights.

 

8. That the developer dedicate right of way for West 15th Street as required by the Department of Public Works so as to provide a total of 60 feet of right of way for West 15th Street.

 

9. That the developer construct West 15th Street to collector street standards as required by the Department of Public Works, including construction of curbs, gutters and sidewalks and installation of streetlights.

 

10. That the developer construct hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

11. That the developer secure a floodplain certificate from the Department of Codes Administration prior to beginning any construction activities within the floodplain.

 

12. That the developer extend sanitary sewers as required by the Department of Public Works.

 

A copy of the preliminary plat is on file in the office of the City Clerk under Document No. 010472, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
