ORDINANCE NO. 190241

 

Calling an election on June 18, 2019, for the purpose of submitting to the voters of Kansas City a question providing for the delay of the effective date of any new caps of economic incentives, including but not limited to, ad valorem real property tax incentives, tax increment financing incentives, Chapter 353 tax incentives, Port Authority incentives, Chapter 100 tax incentives, Land Clearance for Redevelopment Authority tax incentives and Planned Industrial Expansion Authority tax incentives, until a like cap has been enacted by the Kansas Border Counties bordering Kansas City, Missouri; enacting the proposed ordinance contingent upon voter approval; directing the City Clerk to notify the responsible election authorities on or before April 9, 2019; and recognizing this ordinance as having an accelerated effective date because it calls an election.

 

WHEREAS, the economic viability of Kansas City, Missouri, is critically important to the sustainability of an environment that promotes Kansas City as a place to live, work and play; and

 

WHEREAS, Kansas City’s business and development community are an important piece of providing for a sustainable community that results in the creation of jobs for its citizens; and

 

WHEREAS, Kansas City is in a constant competing environment for sustainable economic development with the bordering Kansas counties of Douglas, Johnson, Miami, and Wyandotte and it is critically important that Kansas City, Missouri can continue to compete with those Kansas counties to bring quality jobs to Kansas City and any incentive caps that may be enacted after June 17, 2019, by the Council or the voters of Kansas City must recognize this competitive environment and be delayed from taking effect until those Kansas counties enact like legislation capping incentives; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. ELECTION CALLED. That an election is called on June 18, 2019, for the purpose of submitting to the voters of Kansas City the question of providing for the delay of the effective date of any new caps of economic incentives that may be enacted after June 17, 2019, including but not limited to, ad valorem real property tax incentives, tax increment financing incentives, Chapter 353 tax incentives, Port Authority incentives, Chapter 100 tax incentives, Land Clearance for Redevelopment Authority tax incentives and Planned Industrial Expansion Authority tax incentives, until a like cap has been enacted by the Kansas Border Counties bordering Kansas City, Missouri.

 

Section 2. BALLOT TITLE. The ballot title shall be:

QUESTION NO. _____

Shall the City of Kansas City delay the effective date of any new caps of economic incentives that may be enacted after June 17, 2019, including but not limited to, ad valorem real property tax incentives, tax increment financing incentives, Chapter 353 tax incentives, Port Authority incentives, Chapter 100 tax incentives, Land Clearance for Redevelopment Authority tax incentives and Planned Industrial Expansion Authority tax incentives, until a like cap has been enacted by the Kansas Border Counties bordering Kansas City, Missouri, which include Douglas, Johnson, Miami and Wyandotte, in order to continue to put Kansas City, Missouri in the best position to compete with those counties for quality jobs?

Section 3. NOTICE TO ELECTION AUTHORITIES BY CITY CLERK. That following passage of this ordinance the City Clerk shall deliver certified copies of this ordinance and notice of election to the Clerk of Cass County, Board of Election Commissioners of Clay County, Board of Election Commissioners of Kansas City, and Board of Election Commissioners of Platte County, on or before April 9, 2019, which shall be the authority of each election authority of the City to submit the questions to the electors of Kansas City and to give public notice as provided by law.

 

Section 4. NOTICE OF ELECTION. The notice of election shall read as follows:

KANSAS CITY, MISSOURI

 

Notice is hereby given that the City of Kansas City has called an election to be held on Tuesday, June 18, 2019, between the hours of 6:00 a.m. and 7:00 p.m., at which election all qualified voters residing within Kansas City, Missouri will be given the opportunity to vote.

 

The official ballot will be in substantially the following form:

Section 5. ENACTMENT OF POLICY.  That a new ordinance is enacted, contingent upon approval of the voters at an election to be held on June 18, 2019, to read as follows:

 

Section A. Any new caps of economic incentives that may be enacted after June 17, 2019, including but not limited to, ad valorem real property tax incentives, tax increment financing incentives, Chapter 353 tax incentives, Port Authority incentives, Chapter 100 tax incentives, Land Clearance for Redevelopment Authority tax incentives and Planned Industrial Expansion Authority tax incentives, are hereby delayed and of no force or effect until a like cap has been enacted by the Kansas Border Counties bordering Kansas City, Missouri, which include Douglas, Johnson, Miami and Wyandotte, in order to continue to put Kansas City, Missouri in the best position to compete with those counties for quality jobs and to sustain the long term viability of Kansas City, Missouri.

  

Section 6. ACCELERATED EFFECTIVE DATE RECOGNIZED. This ordinance, providing for the submission of a question to the people of Kansas City, Missouri, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(A) of the City Charter, and shall take effect in accordance with Section 503.
