COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 080041

 

Appropriating $1,262,668.00 for the widening of Barry Road east of I-29 in the Capital Improvements Sales Tax Fund; stating the intent of the Council to allocate this amount in the next fiscal year; designating requisitioning authority; and recognizing an emergency.

 

WHEREAS, the Public Improvements Advisory Committee (PIAC) recently recommended an allocation of $1,262,668.00 as part of the FY 2008-09 capital budget for widening of Barry Road east of I-29; and

WHEREAS, the City seeks to begin right of way acquisition and utility relocation work without further delay; and

WHEREAS, the Capital Improvements Sales Tax Fund currently has sufficient Unappropriated Fund Balance to provide funds to begin work on this project and will have sufficient funds to reimburse this amount to the fund balance in FY 2008-09; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the sum of $1,262,668.00 is hereby appropriated from the Unappropriated Fund Balance of the Capital Improvements Sales Tax Fund to the following account:

08-3090-898012-B Barry Road East of I-29 $1,262,668.00

  Section 2. That the City Council hereby accepts the Public Improvement Advisory Committee (PIAC) recommended allocation of $1,262,668.00 in the FY 2008-09 Capital Improvements Sales Tax City-wide Program and states its intent to return this amount to the Capital Improvements Sales Tax Funds Unappropriated Fund Balance in FY 2008-09.

  Section 3. That the Director of Public Works is hereby designated requisitioning authority for Account No. 08-3090-898012.

Section 4. That this ordinance is recognized as an emergency measure within the provisions of Section 503 of the City Charter in that it appropriates money, and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
