ORDINANCE NO. 160039

 

Deleting approximately 0.77 acres from an existing 6.7 acre development plan currently zoned UR (Urban Redevelopment District) and thereby leaving the remaining UR development plan intact, said deleted area located about 100 feet south of E. 16th Street between Grand Boulevard and McGee Street. (12849-UR-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District UR (Urban Redevelopment District) on approximately a 6.7 acre tract of land generally located about 100 feet south of E. 16th Street between Grand Boulevard and McGee Street, and more specifically described as follows:

 

Lots 850 through 855, Block 61, McGee's Addition, to the City of Kansas, a subdivision in Kansas City, Jackson County, Missouri, except the east 14 feet thereof, taken for street right-of-way; together with Lots 281 through 286, Block 20, McGee's Addition, except the west 14 feet thereof, taken for street right-of-way; together with Lots 287 through 297, said Block 20, except the east 14 feet of said Lot 297 and except the west 14 feet of said Lot 287, taken for street right-of-way; together with the north/south alley first east of McGee Street from the north line of Lot 281 said Block 20 and Lot 85 0, said Block 61, to the north line of said Lots 287 through 297, said Block 20; together with 16th Street from the west right of way line of McGee Street to the east right-of-way line of Oak Street, as they now exist; together with a tract of land shown on the plat of McGee's Addition and described as being reserved from public use and title kept in proprietor; said tract being described in City Assessor's tax description as a/k/a Block 21, McGee's Addition, except the east 14 feet of said tract taken for street right-of-way and except the west 14 feet of said tract taken for street right-of-way; said tract being more particularly described as follows: Commencing at the intersection of the north right-of-way line of 17th Street and the east right-of-way line of McGee Street, as they now exist, said point being the point of beginning of the herein described tract; thence north along the east right of way line of McGee Street, as it now exists, to the south right-of-way line of 16th Street; thence east along the south right-of-way line of 16th Street, to the west right-of-way line of Oak Street as it now exists; thence· south along the west right-of-way line of Oak Street, as it now exists, to the north right-of-way line of 17th Street; thence west along the north right-of-way line of 17th Street, to the point of beginning; together with all of Block 22, said McGee's Addition, except the following described tract; commencing at the northeast comer of Lot 298, said Block 22, said point being on the south right-of-way line of 16th Street and the west right-­of-way line of McGee Street as both now exist; thence south along the west right-of­-way line of McGee Street, 74.86 feet; thence west along a line 74.86 feet south of and parallel to the south right-of-way line of 16th Street, to the center of the north/south alley in said Block 22; thence north along the centerline of said alley, a distance of 0.61 feet, to a point 74.25 feet south of the south right-of-way line of said 16th Street; thence west along a line 74.25 feet south of and parallel to the south right-of-way line of said 16th Street, to the east right-of-way line of Grand Avenue; thence north along said east right-of-way line, a distance of 74.25 feet to a point on the south right-of­-way line of said 16th Street; thence east along said south right-of-way line, to the point of beginning; together with that part of McGee Street from the south right-of-­way line of 16th Street to the north right-of-way line of 17th Street as they now exist, except the north 74.86 feet thereof.

 

for the purpose of deleting therefrom an approximately 0.77 acre tract of land, more specifically described as follows:

 

All that part of Lots 2 and 3, together with a vacated alley, as vacated in Ordinance No. 060333, Document No. 2006E0024989, lying adjacent to and adjoining said Lots, Star Oak Street Addition, a subdivision lying in the Southeast Quarter of Section 5, Township 49 North, Range 33 West, in Kansas City, Jackson County, Missouri, described as follows: Beginning at the Northeast Corner of said Lot 2; thence South 02 degrees 24 minutes 13 seconds West, along the East line of said Lot 2, a distance of 135.28 feet to a point; thence North 87 degrees 35 minutes 51 seconds West, departing the East line of said Lot 2, a distance of 247.68 feet to a point on the West line of said Lot 3; thence North 02 degrees 22 minutes 05 seconds East, along the West line of said Lot 3, a distance of 135.89 feet to the Northwest Corner of said Lot 3; thence South 87 degrees 35 minutes 51 seconds East, along the North line of said Lots 3, a distance of 122.62 feet to a point on the centerline of a vacated alley, as vacated in Ordinance No. 060333, Document No. 2006E0024989, and filed in Jackson County, Missouri; thence South 02 degrees 22 minutes 59 seconds West, along the centerline of said vacated alley, a distance of 0.61 feet to a point on the Westerly prolongation of the North line of said Lot 2; thence South 87 degrees 35 minutes 51 seconds East, along said Westerly prolongation and along the North line of said Lot 2, a distance of 125.14 feet to the point of beginning, containing 33,588 Square Feet or 0.7710 Acres, more or less.

 

so that the remaining tract of land of approximately 5.35 acres, more specifically described as follows:

 

Portions of Star Oak Street Addition, a subdivision lying in the Southeast Quarter of Section 5, Township 49 North, Range 33 West, in Kansas City, Jackson County, Missouri, and being more particularly described as follows: All of Lot 1, of said Star Oak Street Addition, containing 199,495 square feet or 4.5798 acres, more or less.

 

AND ALSO,

 

All that part of Lots 2 and 3, together with a vacated alley way, as vacated in Ordinance No. 060333, Document No. 2006E0024989, lying adjacent to and adjoining said Lots 2 and 3 and being more particularly described as follows: Commencing at the Northeast Corner of said Lot 2; thence South 02 degrees 24 minutes 13 seconds West, along the East line of said Lot 2, a distance of 135.28 feet to a to the point of beginning; thence continuing South 02 degrees 24 minutes 13 seconds West, along the East line of said Lot 2, a distance of 121.00 feet to a point of curvature, said point also lying on the South line of said Lot 2; thence in a Southwesterly direction, departing the East line of said Lot 2, along the South line of said Lot 2, and along a curve to the right, having a radius of 15.00 feet, through a central angle of 90 degrees 01 minute 37 seconds, an arc length of 23.57 feet to a point of tangency; thence North 87 degrees 34 minutes 10 seconds West, continuing along the South line of said Lot 2, and along the South line of a vacated alley, as vacated in Ordinance No. 060333, Document No. 2006E0024989, and filed in Jackson County, Missouri, and along the South line of Lot 3 of said Star Oak Street Addition, a distance of 217.60 feet to a point of curvature; thence in a Northwesterly direction, continuing along the South line of said Lot 3, along a curve to the right, having a radius of 15.00 feet, through a central angle of 89 degrees 56 minutes 15 seconds, an arc distance of 23.55 feet to a point of tangency, said point also lying on the West line of said Lot 3; thence North 02 degrees 22 minutes 05 seconds East, departing the South line of said Lot 3, along the West line of said Lot 3, a distance of 120.90 feet to a point; thence South 87 degrees 35 minutes 51 seconds East, departing the West line of said Lot 3, a distance of 247.68 feet to the point of beginning, containing 33,569 square feet or 0.7706 acres, more or less.

 

The above described 353 Redevelopment descriptions contain an aggregate total of 233,064 square feet or 5.3504 acres, more or Less.

 

is hereby approved, subject to the following conditions:

 

All prior conditions contained within Committee Substitute for Ordinance No. 021115 remain in place.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
