RESOLUTION NO. 050414
Approving
an amendment to the Westside Area Plan by modifying the Land Use Plan and Map
for an area of approximately 9 acres generally bounded by 21st Street and
Southwest Boulevard on the north and northwest, Broadway/West Pennway Viaduct
on the east, the Kansas City Terminal Railway on the south and Interstate 35 on
the west by changing the recommended land use on the above listed location from
Light Industry to Mixed Use. (121-S-6)
WHEREAS, by
Committee Substitute for Resolution No. 971137 adopted September 4, 1997, the
City adopted the Westside Area Plan as a guide for development and
redevelopment of that area generally bounded by 12th Street on the north, 31st
Street on the south, Broadway on the east and the Bluffs and Southwest
Boulevard on the west; and
WHEREAS, said
Westside Area Plan was amended on October 24, 2002, through the adoption of
Resolution No. 021193; was further amended on August 14, 2003 through the
adoption of Resolution No. 030839, and
WHEREAS, after
further review by the City Development Department it has been deemed
appropriate to amend the Westside Area Plan as it affects that area of
approximately 9 acres generally bounded by 21st Street and Southwest
Boulevard on the north and northwest, Broadway/West Pennway Viaduct on the
east, the Kansas City Terminal Railway on the south and Interstate 35 on the
west by changing the recommended land use on the above listed location from
Light Industry to Mixed Use; and
WHEREAS, public
notice of a hearing before the City Plan Commission was published on March 21,
2005; and
WHEREAS, the
City Plan Commission considered such amendment to the Proposed Land Use Plan
and Map on __________, 2005; and
WHEREAS, after
all interested persons were given an opportunity to present testimony, the City
Plan Commission did on _____________, 2005, recommend approval of the proposed
amendment to the Westside Area Plan; NOW, THEREFORE,
BE IT RESOLVED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
this amendment to the Westside Area Plan is hereby approved as to the Proposed
Land Use Plan and Map for that area of approximately 9 acres generally bounded
by 21st Street and Southwest Boulevard on the north and northwest,
Broadway/West Pennway Viaduct on the east, the Kansas City Terminal Railway on
the south and Interstate 35 on the west by changing the recommended land use on
the above listed location from Light Industry to Mixed Use. A copy of the
amended Land Use Plan and Map for the Westside Area Plan is attached hereto as
Exhibit A and made a part hereof.
Section B. That
the amendment to the Westside Area Plan is consistent and complies with the
FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute
for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas
City Plan.
Section C. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by law have
been given and had.
