ORDINANCE NO. 120712

 

Finding the Stuart Hall/HD Lee PIEA Planning area, as further amended, to be blighted and in need of redevelopment; approving the Third Amendment to the General Development Plan for the Stuart Hall/HD Lee PIEA Planning Area generally located on about 0.89 acres generally located at the southwest corner of W. 21st Street and Central Street and also at the southeast corner of W. 21st Street and Central Street and more specifically know as 2100, 2101 and 2107 Central Street in Kansas City, Jackson County, Missouri; and approving ad valorem tax benefits therefor. WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri, (the “Authority”) adopted Resolution No. 823 on December 5, 2003, finding that the area described herein to be blighted pursuant to PIEA Law and recommending to the City Council of Kansas City, Missouri that said area be designated as blighted, unsanitary, or an underdeveloped industrial area defined by Section 100.310(2), 100.310(11), and 100.310(18), RSMo; and  

WHEREAS, the area was declared to be blighted by the City Council through adoption of Resolution No. 031355 on December 18, 2003; and

WHEREAS, the Council approved the General Development Plan for the Stuart Hall/HD Lee PIEA Planning Area on June 3, 2004, by passage of Committee Substitute for Ordinance No. 040469; and

WHEREAS, on April 29, 2005, the Authority adopted Resolution No. 976, approving the First Amendment to the Stuart Hall/HD Lee PIEA Planning Area, finding the expanded area to be a blighted, unsanitary, or an underdeveloped industrial area defined by Section 100.310(2), 100.310(11), and 100.310(18), RSMo, and  recommending that the First Amendment be approved; and

WHEREAS, the City Plan Commission reviewed and recommended approval of the finding of blight for the area, as amended, and the First Amendment to the General Development Plan for the Stuart Hall\HD Lee PIEA Planning Area on June 21, 2005, and found the plan to be in conformance with the general plan for the development of the community as a whole; and

WHEREAS, the Council approved the First Amendment to the General Development Plan for the Stuart Hall/HD Lee PIEA Planning Area on June 30, 2005, by passage of Committee Substitute for Ordinance No. 050718; and

WHEREAS, on March 30, 2007, the Authority adopted Resolution No. 1210 approving the Second Amendment to the Stuart Hall/HD Lee PIEA Planning Area, finding the expanded area to be a blighted, unsanitary, or an underdeveloped industrial area defined by Section 100.310(2), 100.310(11), and 100.310(18), RSMo, and recommending that the Second Amendment be approved; and

WHEREAS, the City Plan Commission reviewed and recommended approval of the finding of blight for the area, as amended, and of the Second Amendment to the General Development Plan for the Stuart Hall\HD Lee PIEA Planning Area on April 17, 2007, and found said plan to be in conformance with the general plan for the development of the community as a whole; and;

WHEREAS, the Council approved the Second Amendment to the General Development Plan for the Stuart Hall/HD Lee PIEA Planning Area on April 26, 2007, by passage of Ordinance No. 070431; and

WHEREAS, on May 30, 2012, the Authority adopted Resolution No. 1500 approving the Third Amendment to the Stuart Hall/HD Lee PIEA Planning Area, finding the expanded area to be a blighted, unsanitary, or an underdeveloped industrial area defined by Section 100.310(2), 100.310(11), and 100.310(18), RSMo, and  recommending that the Third Amendment be approved; and

WHEREAS, the City Plan Commission has reviewed and recommended approval of the finding of blight for the area, as amended, and of the Third Amendment to the General Development Plan for the Stuart Hall\HD Lee PIEA Planning Area on July 17, 2012, and has found said plan to be in conformance with the general plan for the development of the community as a whole; and;

WHEREAS, Section 100.400, RSMo, authorizes the Council to approve a general development plan after a designation of blight if the Council finds that the plan is feasible and in conformity with the general plan for the redevelopment of the community as a whole; and 

WHEREAS, the Council has determined that ad valorem tax exemption benefits as authorized in Section 100.570, RSMo, are necessary to attract developers to the expanded area; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Stuart Hall/HD Lee PIEA Planning Area, as further amended, is hereby found to be a blighted, unsanitary or an undeveloped industrial area as defined by Section 100.310, RSMo.

Section 2. That the Third Amendment to the General Development Plan for Stuart Hall/HD Lee PIEA Planning Area, as shown in the plan and blight analysis dated May 30, 2012, and revised July 17, 2012, generally located on about 0.89 acres generally located at the southwest corner of W. 21st Street and Central Street and also at the southeast corner of W. 21st Street and Central Street, in Kansas City, Jackson County, Missouri, and legally described as: 

 

The 3rd Amended Stuart Hall/H.D. Lee PIEA Planning Area is generally bounded by Southwest Boulevard and West 21st Street on the north, Baltimore Avenue and St. Paul Avenue on the east, West 22nd Street on the south, and Northwestern Avenue, Central Street, and Wyandotte Street

on the west, and more specifically described as follows:

 

Beginning at the intersection of the centerline of Southwest Boulevard, as now established, and the northerly prolongation of the west right-of-way line of Wyandotte Street, as now established; thence northeast along said centerline of Southwest Boulevard to its intersection with the northerly prolongation of the east boundary of Lot 9, Block 13, Goodrich Addition, a subdivision in Kansas City, Jackson County, Missouri; thence southeast along said line to the east right-of-way line of the alley lying south and adjacent to said Lot 9, Block 13, Goodrich Addition, a subdivision in Kansas City, Jackson County, Missouri; thence southwest along said right-of-way line to the centerline of vacated St. Paul Avenue; thence south along said centerline to its intersection with the westerly prolongation of the north boundary line of Lot 21, Block 13, Goodrich Addition, a subdivision in Kansas City, Jackson County, Missouri; thence east along the north line of Lot 21 and its easterly prolongation to its intersection with the east right-of-way line of Baltimore Avenue, as now established; thence south along said line to its intersection with the easterly prolongation with the south boundary line of Lot 2, Block 17, Goodrich Addition, a subdivision in Kansas City, Jackson County, Missouri; thence west along said south line to its intersection with the west right-of-way line of St. Paul Avenue, as now established; thence south along said west line to its intersection with the south right-of-way line of West 22nd Street, as now established; thence west along said south line to its intersection with the east right-of-way line of Central Street, as now established; thence north along said east line to its intersection with the easterly prolongation of the south boundary line of Lot 2, Block 24, Goodrich Addition, a subdivision in Kansas City, Jackson County, Missouri; thence west along said south line to its intersection with the west right-of-way line of Northwestern Avenue, as now established; thence north along said west line to its intersection with the north right-of-way line of West 21st Street, as now established; thence east along said north line to its intersection with the west right-of-way line of Central Street, as now established; thence north along said west line to its intersection with the westerly prolongation of the north right-of-way line of West 21st Street, as now established; thence east along said north line to its intersection with the northerly prolongation of the east right-of-way line of Ft. Scott Avenue, as now established; thence south along said east line to its intersection with the north boundary line of Freight House Flats, a condominium plat, a replat of Lots 9-14, Block 21, Goodrich Addition, a subdivision in Kansas City, Jackson County, Missouri; thence east along said north line to its intersection with the west right-of-way line of Wyandotte Street, as now established; thence north along said west line and its northerly prolongation to the point of beginning. 

is hereby approved. A copy of said plan is attached to this ordinance and is made a part hereof.

Section 3. That the Council has duly made the findings necessary for compliance with Section 100.300-100.620, RSMo.

Section 4. That said Third Amendment to the General Development Plan for the Stuart Hall/HD Lee PIEA Planning Area is hereby found to be feasible and in conformance with the general plan for the development of the community as a whole.

Section 5. That the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo, are hereby extended to the plan area, as amended by the Third Amendment, to the extent and in the manner as provided for in said General Development Plan, subject to the execution of a development agreement with the Authority.
