ORDINANCE NO. 120958

 

Expressing the Council’s desire that pension amendments be presented to it by December 13, 2012; and directing the City Manager to prepare pension funding policies to be used as the basis for negotiations with employee groups.

 

WHEREAS, the City Manager and representatives from the police, firefighters’ and City employees’ pension systems have been meeting for many months in an attempt to find mutually agreeable modifications to unsustainable pension systems; and

 

WHEREAS, these meetings were commenced with a goal of reaching appropriate solutions to the issue of providing properly funded pensions to City and police employees; and

 

WHEREAS, the Mayor and Council expressed their desire for a solution that could be implemented as soon as possible, but no later than the fiscal year beginning May 1, 2013; and

 

WHEREAS, the City Manager and representatives from the police, firefighters’ and City employees’ pension systems have held many meetings, often facilitated by an independent actuary; and

 

WHEREAS, these meetings have required the cooperation of each pension board to provide through the boards’ actuaries detailed information important to reaching appropriate resolutions for pensions and pension funding; and

 

WHEREAS, there are separate avenues for resolution because of the separate nature of the pension systems, including a reopening of negotiations with IAFF, Local 42, ratification of a collective bargaining agreement and then pension negotiations with AFSCME, Local 500, and amendments to Chapter 86, Revised Statutes of Missouri, for the two police pension systems by the Missouri General Assembly; and

 

WHEREAS, to meet the schedule for adoption of a fiscal year 2013-14 budget these necessary negotiations must commence promptly; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Mayor and City Council express their desire that the City Manager and representatives from the police, firefighters’ and City employees’ pension systems can provide to the City Council an initial plan for amendments to the four pension systems by December 13, 2012.

 

Section 2. That the City Manager shall develop proposed policies for appropriately funding pension systems that can be used as guides during the negotiations with employee groups on the matter of pensions, and that the guides will be treated by the Mayor and City Council as closed records pursuant to §610.021(9), Revised Statutes of Missouri, authorizing the closing of records and meetings relating to the “preparation, including any discussions or work product, on behalf of a public governmental body or its representatives for negotiations with employee groups.”
