Approving an amended Community Unit Project in District R-1aa (one family dwellings, low density) on a 38.5 acre tract of land generally located on the west side of Noland Road approximately 2,000 feet north of Bannister Road (12390-CUP-7)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amended Community Unit Project in District R-1aa (One-Family Dwellings, Low Density) on a 38.5 acre tract of land generally located on the west side of Noland Road, approximately 2,000 feet north of Bannister Road, and more specifically described as follows:

 

All that part of the Northeast Quarter of Section 27, and all that part of the Northwest Quarter of Section 26, all in Township 48 North, Range 32 West, and all that part of vacated Vale Road and all that part of Lots 37, 38, 39, and 40, UNITY RIDGE AND GARDENS, a subdivision in Kansas City, Jackson County, Missouri, described as follows:

 

COMMENCING at the Common Section corner at Sections 22, 23, 26 and 27, Township 48 North, Range 32 West; Thence S0227'41"W along the East line of the Northeast Quarter of Section 27, a distance of 1138.85 feet; Thence S8732'19"E, a distance of 34.34 feet to the POINT OF BEGINNING; Thence S7349'51"E, a distance of 244.07 feet; Thence N7508'26"E, a distance of 163.89 feet; Thence N3131'26"E, a distance of 173.49 feet; Thence N6639'16"E, a distance of 50.00 feet to a point on the Westerly right of way line of Noland Road; Thence along said Westerly right of way line and along a non-tangent curve to the right having a central angle of 2655'06" and a radius of 2824.79 feet, the radius point bears S6639'16"W; Thence Southerly and to the right along the arc of that curve a distance of 1327.12 feet to the Point of Tangent; Thence S0334'22"W and continuing along said westerly right of way line, a distance of 149.27 feet to a point on the South line of Lot 37, Unity Ridge and Gardens a subdivision in Kansas City, Jackson County, Missouri, according to the recorded Plat thereof; Thence S8643'46"W along the South line of said Lot 37, Unity Ridge and Gardens, a distance of 764.65 feet; Thence N2054'11"W, a distance of 266.63 feet; Thence N3948'58"W, a distance of 304.89 feet; Thence N7853'18"W, a distance of 333.40 feet; Thence S7901'06"W, a distance of 185.30 feet; Thence S8949'30"W, a distance of 503.79 feet; Thence N0219'15"E, a distance of 410.68 feet; Thence N8743'55"E, a distance of 316.84 feet; Thence N5824'27"E, a distance of 299.14 feet; Thence S1134'54"E, a distance of 140.46 feet; Thence S2902'29"E, a distance of 126.06 feet; Thence S7106'22"E, a distance of 141.32 feet; Thence N64'41'16"E, a distance of 178.61 feet; Thence N3939'56"E, a distance of 111.12 feet; Thence N1148'43"E, a distance of 208.05 feet; Thence N1926'18"E, a distance of 419.23 feet; Thence S8451'59"E, a distance of 51.18 feet; Thence S1202'18"E, a distance of 211.40 feet to the POINT OF BEGINNING. Said Tract of land contains 38.49 acres more or less.

 

is hereby approved, subject to the following conditions:

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

2. That the developer submit an amended storm drainage study for the entire development to the City Engineers Office for approval when the first final plat is submitted and that the developer construct any improvements as required by the City Engineers Office.

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

5. That a waiver to the provisions of Section 66-83(f) is hereby granted so as to permit construction of sidewalks on only one side of the internal streets as indicated on the Community Unit Project plan and that the developer construct these sidewalks in accordance with the requirements of the Department of Public Works.

6. That the developer submit covenants, conditions and restrictions with the final plats to the Law Department for approval for the maintenance of private open space, all common areas, and any detention areas.

7. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

8. That the developer extend water mains as required by the Water Services Department.

9. That the developer extend sanitary sewers as required by the Department of Public Works.

10. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

11. That the developer submit a street name signage plan to the Street Naming Committee for approval.

12. That the limits of the 100 year floodplain and the lowest opening or elevation or Minimum Low Opening (MLO) of any structure on each lot that abuts a 100 year flood prone area be shown on the final plat.

A copy of said Community Unit Project plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
