Approving an amendment to a previously
approved preliminary plan in District C-2-p on a 1.9 acre tract of land
generally located on the west side of N. Oak Trafficway about 250 feet north of
the Gladstone city limits (11631-P-5)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
an amendment to a previously approved preliminary plan in C-2-p (Local Retail
Business - Limited District) on a 1.9 acre tract of land generally located on
the west side of N. Oak Trafficway about 250 feet north of the Gladstone city
limits and more specifically described as follows:
TRACT I: (7718
N. Oak Trafficway): The east 200 feet of Lot 4, Lawn Acres No. 2, a
subdivision of land in Kansas City, Clay County, Missouri, except that part
conveyed to the City of Kansas City, Missouri, in Book 1941 at Page 107, as
Document No. G-52008.
TRACT II: (7724
N. Oak Trafficway): The east 200 feet of Lot 3, Lawn Acres No. 2, a
subdivision in Kansas City, Clay County, Missouri, except that part conveyed to
the City of Kansas City, Missouri in Book 1943 at Page 108, as Document No.
G-52956.
TRACT III: (7730
N. Oak Trafficway): All of Lot 2, Lawn Acres No. 2, a subdivision in Kansas
City, Clay County, Missouri, except that part conveyed to the City of Kansas
City, Missouri in Book 1941 at Page 579, as Document No. G-52177.
TRACT IV: (7740
N. Oak Trafficway): All of Lot 1, Lawn Acres No. 2, a subdivision in Kansas
City, Clay County, Missouri except that part conveyed to the City of Kansas
City, Missouri in Book 1941 at Page 584, as Document No. G-52179, except the
west 40 feet.
is hereby approved, subject to
the following conditions:
1.
That the developer dedicate additional right of way along the north 200
feet of plan frontage, by general warranty deed, for primary arterial with a
bike lane as required by Development Services so as to provide a minimum of 56
feet of right of way as measured from the centerline of N. Oak Trafficway,
prior to issuance of a certificate of occupancy.
2.
That the developer secure permits to construct or reconstruct existing
sidewalks, curb and gutter, storm sewers, and streetlights as necessary along
all development street frontages, or submit a letter from a Missouri Licensed
Civil Engineer stating that the sidewalks, curb and gutter are in a good state
of repair and meet the requirements set forth in Chapters 56 and 64, Code of
Ordinances, as required by Development Services, prior issuance of a
certificate of occupancy.
3.
That the developer submit a detailed micro storm drainage study,
consisting at a minimum of a letter from a Missouri Licensed Civil Engineer
stating that the proposed improvements will not alter or increase historical
runoff conditions for the site, to Development Services prior to approval and
issuance of any building permits, and that the developer construct any
improvements as required by Development Services.
4.
That the developer submit plans for grading and siltation and erosion
control to Development Services for approval prior to the commencement of any
construction activities.
5. That
the developer obtain a site disturbance permit from Development Services prior
to beginning any construction, grading, clearing or grubbing activities, if the
disturbed area exceeds one acre.
6.
That the developer provide for fire protection as required by the Fire
Department prior to construction beyond foundations.
7.
That the developer submit a final plan to the City Plan Commission for
approval, including detailed information on landscaping (including red maples a
maximum of 40 feet on center along the west plan boundary and in the street
setback area along N. Oak Trafficway), signage (including elevations), lighting
(including a photometric study showing zero footcandles at the limited district
plan boundary and no direct illumination beyond the limited district plan
boundary) and building elevations.
A copy of said amendment is on
file in the office of the City Clerk under Document with this ordinance and is
made a part hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
