COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 910321

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2374, rezoning an area of approximately 4.73 acres within the block bounded by Linwood Boulevard, Montgall Avenue, 31st Street, and Prospect Avenue and including the northeast corner of 31st Street and Prospect Avenue from Districts R-4 (Low Apartment), R-5 (High Apartment) and C-2 (Local Retail Business) to District URD (Urban Redevelopment District), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance is hereby amended by enacting a new section to be known as Section 65.010A2374, rezoning an area of approximately 4.73 acres within the block bounded by Linwood Boulevard, Montgall Avenue, 31st Street, and Prospect Avenue and including the northeast corner of 31st Street and Prospect Avenue from Districts R-4 (Low Apartment), R-5 (High Apartment), and C-2 (Local Retail Business) to District URD (Urban Redevelopment District), said section to read as follows:

 

Section 65.010A2374. That an area legally described as:

 

TRACT 1: All of Lots 19 and 20, and the south 30 feet of Lot 21, all in resurvey of Evergreen Heights, a subdivision of the N.W. 1/4 of Section 15-49-33, Kansas City, Jackson County, Missouri.

 

Also, the North 40 feet of Lot 8 and all of Lots 9 through 13, all in Block 2 - Linwood Flower Garden, a subdivision in the N.W. 1/4 of Section 15-49-33, Kansas City, Jackson County, Missouri.

 

TRACT 2: A tract of land in the Northwest Quarter of the Southwest Quarter of Section 15, Township 49, Range 33, in the City of Kansas City, Jackson County, Missouri, described as follows:

 

Beginning at the Southeast corner of 31st Street and Prospect Avenue, said corner being 40 feet South and 40 feet East of the Northwest corner of said Quarter, Quarter Section; thence South 87 degrees 35 minutes 45 seconds East along the South line of 31st Street, as established (40 feet from the centerline thereof, said centerline being also the North line of said Quarter, Quarter Section) a distance of 265.00 feet to the West line of Montgall Avenue, as established (25 feet from the centerline thereof) thence South 2 degrees 13 minutes 03 seconds West along said West line a distance of 568.69 feet to a point on the north line of Linwood Boulevard, as established (50 feet from the centerline thereof); thence North 87 degrees 37 minutes 57 seconds West along said North line, a distance of 265.00 feet to the East line of Prospect Avenue, as established; thence North 2 degrees 13 minutes 03 seconds East along said East line (40 feet from the centerline thereof, said centerline being also the West line of said Quarter, Quarter Section) a distance of 568.86 feet; to the point of beginning containing 150,724.62 square feet, or 3.4602 acres, more or less.

 

is hereby rezoned from Districts R-4 (Low Apartment), R-5 (High Apartment), and C-2 (Local Retail Business) to District URD (Urban Redevelopment District), all as shown outlined on a map marked Section 65.010A2374, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the property to be replatted and processed in accordance with Chapter 31, Code of General

Ordinances, as amended, commonly known as the Subdivision

Regulations and that the developer submit a storm

drainage study as part of the final plat application.

 

2. That the developer dedicate a total of twenty (20) feet additional right of way on 31st Street to provide a total

of one hundred (100) feet of right of way.

 

3. That the developer construct new curb, gutter and sidewalk and remove drive approaches.

 

4. That the developer reduce the width of the driveway on the north side of the bank to thirty (30) feet.

 

5. That the developer widen Prospect Avenue along the frontage of the subject property by seven (7) feet

including reconstruction of sidewalks and adjustment of

streetlights.

 

6. That the developer work with the fire department to provide twenty (20) foot wide access to the rear of the

buildings or install special protection.

 

7. That the developer submit a final landscaping plan for approval by the Director of City Development Department.

 

8. That the developer improve the north-south alley between 30th and 31st Streets.

 

A copy of said development plan is on file in the Office of the City Clerk under Document No. 910321, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
