COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 080295

 

Amending Chapter 48, Nuisance Code, Code of Ordinances, by repealing Section 48-62, Violations for which an order to remove nuisances shall be issued, and enacting in lieu thereof a new section of like number and subject matter regarding notification procedures to be titled Notification to owners, occupants and residents.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That Chapter 48, Code of Ordinances of the City of Kansas City, Missouri, is hereby amended by repealing Section 48-62, Violations for which an order to remove nuisances shall be issued, and enacting in lieu thereof a new section of like number and subject matter, to read as follows:

Sec. 48-62. Notification to owners, occupants and residents.

 

(a) Whenever a nuisance described in section 48-21, 48-23, 48-24, 48-26, 48-29, 48-31, 48-33, 48-34, 48-35, 48-36, 48-37, 48-38, 48-39, 48-40, 48-41, 48-42, 48-43, 48-44, 48-45, 48-46, 48-48 or 48-49 is found upon property, an Order to Remove Nuisances shall be issued by the Director of Neighborhood and Community Services pursuant to section 48-63 to the owner or occupant of such property. For all other nuisances described in this chapter, an Order to Remove Nuisances shall be issued to the owner or occupant of the property only if such owner or occupant does not reside on the property.

 

(b) Whenever a resident of property has not been issued an Order to Remove Nuisances for any of the nuisances described in sections 48-22, 48-25, 48-27, 48-28, 48-30 and 48-32, a Notice of Inspections shall be issued to such resident at least seven days before the resident is charged with a violation or issued an administrative citation for any such nuisance.

 

(c) The Notice of Inspections shall:

 

(1) Be issued by the Director of Neighborhood and Community Services.

 

(2) Be in writing.

 

(3) Be issued by mail to the resident or by posting at the property.

 

(4) State that the property will be inspected after seven days from the date of the notice.

 

(5) Describe the conditions constituting nuisances under section 48-22, 48-25, 48-27, 48-28, 48-30 and 48-32.

 

(6) State that reinspections may occur at any time after the first inspection.

 

(7) State that if violations of the nuisance code described in the notice are found, the resident will be prosecuted or issued an administrative citation.

 

(d) After seven days have expired from the date of issuance of a Notice of Inspections, unlimited inspections and reinspections are permitted. If, during any such inspection or reinspection, any of the nuisance conditions described in the Notice of Inspections are found on the property, regardless of when such nuisance came into existence, the resident may be charged with a violation or issued an administrative citation. The date of issuance of a Notice of Inspections is the date it is mailed or posted.
