COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 120217

 

Amending Section 50-454, Code of Ordinances, entitled "Prohibited locations" by defining the location of approved street vending at the Truman Sports Complex and prohibiting street vending within a Major Sporting Event District.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Section 50-454, Code of Ordinances, is amended by adding a new subsection (a)(6) to read as follows:

 

(6) Within the Truman Sports Complex on the property, including all roads, parking lots, sidewalks, walkways or plazas, enclosed by the road known as Dubiner Circle, except for sales by any tenant of the Truman Sports Complex or its designee.

 

Section 2. That Section 50-454, Code of Ordinances, is amended by adding a new subsection (a)(7) to read as follows:

 

(7) In any Major Sporting Event District, as defined in chapter 50, Code of Ordinances, for which a Major Sporting Event District License, as defined in chapter 50, Code of Ordinances, has been obtained during the term of such Major Sporting Event District License, unless authorized by the holder of the Major Sporting Event District License or unless such vendor is an Approved Food Vendor. For purposes of this Section 50-454(a)(7), the term "Approved Food Vendor" shall mean a street vendor who (i) has a valid vendor certificate together with all required licenses and permits as required by the City, the applicable county, and State of Missouri, as applicable (collectively, the "Required Permits"), (ii) has continuously maintained the necessary Required Permits for a period beginning 120 days prior to the first day of the Term (as defined in chapter 50, Code of Ordinances) through and including the first day of the Term (the "Permit Period"), (iii) only sells food and/or beverages, and (iv) has not modified, changed, altered, amended, or added advertising or signage visible to public view during the Permit Period.
