Approving an amendment to a previously approved development plan in District GP-3/4 on an approximately 2.5 acre tract of land generally located at the southeast corner of N. Congress Avenue and N.W. Prairie View Road. (District LL) (13573-GP-1)

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

  Section A. That an amendment to a previously approved development plan in District GP-3/4 (Regional Business/High-Density Residential) on an approximately 2.5 acre tract of land generally located at the southeast corner of N. Congress Avenue and N.W. Prairie View Road, and more specifically described as follows:

District LL Description:

 

A tract of land in the Northeast Quarter of Section 12, Township 51 North, Range 34 West in Kansas City, Platte County, Missouri described as follows: Commencing at the Northwest corner of said Northeast Quarter; thence South 01015 West along the West line of said Northeast Quarter, 748.51 feet; thence South 894945 East, 100.00 feet to the True Point of Beginning of the tract of land to be herein described, said point also being on the Easterly right-of-way line of N Congress Avenue, as now established and being the Southwest corner of Lot 3, Zona Rosa 2nd Plat, a subdivision of land in said Kansas City; thence North 01015 East along said Easterly right-of-way line and the Westerly of said Lot 3, 288.60 feet; thence North 342259 East along said Easterly right-of-way line, 69.02 feet; thence North 664728 East along said Easterly right-of-way line, 89.11 feet; thence South 00000 West, 2.23 feet; thence South 900000 West, 85.47 feet; thence Southerly along a curve to the right being tangent to the last described course with a radius of 99.41 feet, a central angle of 913610, and an arc distance of 158.94 feet; thence South 00000 West, 91.81 feet; thence North 900000 East, 5.04 feet; thence South 00000 West, 163.00 feet; thence North 900000 East, 5.08 feet to a point on the Easterly line of said Lot 3; thence South 00000 West, 18.50 feet to the Southeast corner of said Lot 3; thence South 900000 West along the South line of said Lot 3, 309.83 feet to the Point of Beginning. Containing 2.48 acres, more or less.

is hereby approved, subject to the following conditions:

1. That the developer submit an update to the previously accepted macro storm drainage study for the overall development, to address the development amendments along with a detailed micro study for review and acceptance, to Development Services prior to review and issuance of any building permits, and that the developer construct any improvements as required by Development Services prior to issuance of a certificate of occupancy.

 

2. That the developer submit a letter from a licensed civil engineer, licensed architect, or licensed landscape architect, who is registered in the State of Missouri, stating the condition of the sidewalks, curbs, and gutters. The letter must identify state of repair as defined in Chapters 56 and 64, Code of Ordinances, for the sidewalks, curbs, and gutters. It shall identify the quantity and location of sidewalks, curbs, and gutters that need to be constructed, repaired, or reconstructed. The developer shall secure permits to repair or reconstruct the identified sidewalks, curbs, and gutters as necessary along all development street frontages, as required by Development Services, prior to issuance of a certificate of occupancy.

 

3. That the developer secure a site disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more, prior to review and issuance of any building permits.

 

4. That the developer provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

5. That the developer receive the approval of the Board of Zoning Adjustment for any necessary variances.

 

6. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

7. That the developer relocate sanitary sewers and determine adequacy as required by Development Services.

 

8. That the developer provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by Development Services.

 

9. That the developer relocate and/or extend water mains as required by the Water Services Department.

 

10. That the developer submit plans for grading and siltation and erosion control to Development Services for approval prior to the commencement of any construction activities.

 

11. That the developer grant a BMP Easement to the City as required by Development Services, prior to issuance of a certificate of occupancy.

 

12. That the developer enter into a covenant agreement for the maintenance of any stormwater detention area tracts as required by Development Services, prior to issuance of a certificate of occupancy.

 

13. That the developer enter into an indemnification agreement with the Water Services Department for the retaining wall constructed over the storm water conveyance system as required by Development Services prior to review and issuance of any building permits.

 

14. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping (including on-site canopy shade trees a maximum average of 50 feet on center along public street frontages), signage (including elevations), lighting (including a photometric study showing zero footcandles at the property line and no direct illumination of any right of way), and building elevations.

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
