ORDINANCE NO. 910274

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2370, rezoning an area of approximately 1.56 acres located on the southwest corner of 46th Street and Wornall Road from District R-5 (High Apartment) to District C-1-p (Neighborhood Retail Business - Limited District), and approving a preliminary plan for the same. (9904-P-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance is hereby amended by enacting a new section to be known as Section 65.010A2370, rezoning an area of approximately 1.56 acres located on the southwest corner of 46th Street and Wornall Road from District R-5 (High Apartment) to District C-1-p (Neighborhood Retail Business - Limited District), said section to read as follows:

 

Section 65.010A2370. That an area legally described as:

 

Lots 32 to 46, inclusive, Block 18, WORNALL PARK, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

is hereby rezoned from District R-5 (High Apartment) to District C-1-p (Neighborhood Retail Business - Limited District), all as shown outlined on a map marked Section 65.010A2370, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer petition for the vacation of the north half of the north/south alley.

 

2. That the developer improve the south half of the north/ south alley to current City standards for alleys.

 

3. That the developer dedicate additional right of way to provide 25 feet from centerline for 46th Terrace.

 

4. That the developer contribute money for off-site transportation improvements in the Plaza Study Area at

the rate of $11.00 per square foot of floor space.

 

5. That the developer submit a storm drainage study to the City Engineer including provision for any needed

improvements.

 

6. That the developer cause the area to be replatted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

7. That the developer submit a final plan for review and approval by the City Plan Commission prior to the

issuance of a building permit.

 

A copy of said preliminary plan is on file in the Office of the City Clerk under Document No. 910274, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
