ORDINANCE NO. 070032

 

Rezoning an area of approximately 0.35 acres generally located at the northeast corner of E. 8th Street and Troost Avenue from District M-1 to District PD/M-1 and approving a development plan for the same. (13630-PD)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0731, rezoning an area of approximately 0.35 acres generally located at the northeast corner of E. 8th Street and Troost Avenue from District M-1 (Light Industry) to District PD/M-1 (Planned District/Light Industry), said section to read as follows:

 

Section 80-11A0731. That an area legally described as:

 

A Replat of lot 10 and Lot 11, Block B, Ranson and Talleys Addition, a subdivision in Jackson County, Missouri, described as follows: Beginning at the northwest corner of Lot 11, Block B of said subdivision; thence South 89 degrees 52 minutes 22 seconds East along the north line of said Lot 11, 150.46 feet to the northeast corner of said Lot 11; thence South 00 degrees 34 minutes 41 seconds East along the east line of said Lots 10 and 11, 100.00 feet to a point on the north right of way line of E. 8th Street, as now established (30.000 from the centerline); thence North 89 degrees 52 minutes 22 seconds West along said right of way line, 150.66 feet to a point on the east right of way line of Troost Avenue, as now established (30.00 feet from the centerline); thence North 00 degrees 27 minutes 45 seconds West along said right of way line, 100.00 feet to the point of beginning. Containing 0.35 acres, more or less and subject to any easements.

 

is hereby rezoned from District M-1 (Light Industry) to District PD/M-1 (Planned District/Light Industry), all as shown outlined on a map marked Section 80-11A0731, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

(for City Plan Commission). That a x ft. variance to the minimum required right-of-way width of 50 ft. for a minor (local residential) street so as to permit 40 ft. of right-of-way as shown on the development plan is hereby granted.

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer secure a site disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

3.                  That any relocated streetlights be integrated into the existing street light system, as required by the City Engineers Office.

 

4.                  That the developer secure permits to construct new, or reconstruct existing, sidewalks, curbs, and gutters as necessary along all development street frontages, or submit a letter from a Missouri licensed civil engineer stating that the sidewalks, curbs, and gutters are in a good state of repair and meet the requirements set forth in Chapters 56 and 64, Code of Ordinances, as required by Development Services, prior to recording the plat.

 

5.                  That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri licensed civil engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to Development Services prior to review and issuance of any building permits, and that the developer construct any improvements as required by Development Services.

 

6.                  That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

7.                  That the developer extend water mains as required by the Water Services Department.

 

8.                  That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of common elements.

 

9.                  That the developer extend sanitary sewers to ensure individual service is provided to all proposed lots and units and determine adequacy as required by Development Services.

 

10.              That the developer provide for fire protection as required by the Fire Department.

 

11.              That the developer obtain the grading consents, and all grading, temporary construction and drainage easements from the abutting property owner prior to submitting any public improvements.

 

12.              That the developer request approval of any necessary variances from the Board of Zoning Adjustment, as determined by the Permit Division.

 

13.              That the developer submit a final plan to the City Plan Commission for approval including plans for building materials, elevations, landscaping, grading, signage, screening, berming, and fencing.

 

14.              That the City Plan Commission grant a 10 foot variance to the Major Street Plans minimum required right-of-way width of 80 feet for a secondary arterial street so as to permit 60 feet of right-of-way as shown on the development plan.

 

15.              That the developer contribute $1,326.89 in lieu of parkland dedication for 6 single family lots (6 x 3.7 persons per household x 0.006 acre per person x $9,961.61) in satisfaction of Section 66-128 of the Subdivision Regulations at a rate of $9,961.61, per acre (average cost per acre of parkland for 2006.)

 

16.              That a minor subdivision be approved prior to sale of individual units.

17.              (for City Plan Commission). That a x ft. variance to the minimum required right-of-way width of 50 ft. for a minor (local residential) street so as to permit 40 ft. of right-of-way as shown on the development plan is hereby granted.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
