COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 200381

 

Declaring the City Council’s intent that all Coronavirus Aid, Relief, and Economic Security (CARES) Act funds received by the City from Cass, Clay, Jackson, and Platte Counties be allocated for projects and activities occurring within each county, respectively, unless administrative in nature or not otherwise readily divisible based on geographic boundaries; and declaring the Council’s intent to reimburse Cass, Clay, Jackson, and Platte Counties for any expenditures determined to be ineligible.

WHEREAS, a novel coronavirus designated as COVID-19 has spread throughout the world and has been declared a global pandemic by the World Health Organization; and

 

WHEREAS, the pandemic has caused significant budgetary constraints for local governments including the City of Kansas City; and

 

WHEREAS, the CARES Act was passed by the United States Congress and signed into law by the President of the United States on March 27, 2020; and

 

WHEREAS, the CARES Act created a Coronavirus Relief Fund which appropriated $150 billion to States and certain units of local government for reimbursement of certain pandemic-related expenditures; and

 

WHEREAS, both the United States government and the State of Missouri are allocating portions of Coronavirus Relief Funds to the four counties in which Kansas City is situated; and

 

WHEREAS, Cass, Clay, Jackson, and Platte Counties desire to support the City by providing a portion of funds they receive from the federal and state governments to provide for reimbursement of eligible expenditures of the City; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Council hereby declares its intent that all CARES Act funds that are distributed by Cass, Clay, Jackson, and Platte Counties to the City, except for costs that are administrative in nature or not otherwise readily divisible based on geographic boundaries, shall be allocated to the specific projects and activities occurring only within the corporate boundaries of the City of Kansas City, Missouri and the specific county providing funds, except for costs that are administrative in nature or not otherwise readily divisible based on geographic boundaries..

 

Section 2. That the City Council declares its intent that if it is determined by the Inspector General of the United States or the Treasurer of the State of Missouri (collectively “Government Authorities”) that any expenditure, in whole or in part, by the City was ineligible for reimbursement and the recoupment of such funds are demanded of Cass, Clay, Jackson, or Platte County by a Government Authority, then the City shall, to the extent allowed by law and subject to appropriation, reimburse the County to the full extent of the disallowance.
