ORDINANCE NO. 050903

 

Approving the preliminary plat of Bisceglia Heritage on a 1.49 acre tract of land generally located on the north side of Independence Avenue, between Wabash and Olive Streets. (SD 1186)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Bisceglia Heritage on a 1.49 acre tract of land generally located on the north side of Independence Avenue, between Wabash and Olive Streets, and more specifically described as follows:

 

That part of the Southeast Quarter of Section 33, Township 50, Range 33 in Kansas City, Jackson County, Missouri, being more particularly described as follows: Beginning at the intersection of the northerly right-of-way line of Independence Boulevard with the westerly right-of-way line of Wabash Avenue, as said boulevard and avenue are now established; thence North 90-0'-00" West along said northerly right-of-way line, a distance of 255.13 feet to a point of intersection with the easterly right-of-way line of olive street, as now established; thence North 0-15'-28" West along said easterly right-of-way line, a distance of 297.50 feet; thence North 89-59'-43" West, departing said easterly right-of-way line, a distance of 110.82 feet; thence South 0-30'-39" East, a distance of 75.00 feet; thence South 90-00'-00" East, a distance of 143.00 feet to a point on the westerly right-of-way line of Wabash Avenue, as now established; thence South 0-30'-39" East along said westerly right-of-way line, a distance of 222.50 feet to the point of beginning. The above description contains 64,978.57 square feet or 1.49 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer shall cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That a variance to the minimum lot depth requirement of 110 feet be waived for proposed Lot 2.

 

3. That the developer secure permits to repair sidewalks, curbs and gutter as necessary along all development street frontages as required by Development Services in accordance with Chapter 56 and 64 Code of Ordinances, prior to recording the final plat.

 

4. That any necessary variances to required setbacks be obtained for the existing structures.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
