ORDINANCE NO. 200262, AS AMENDED

 

Authorizing the City Manager and the Manager of Procurement Services to enter into any and all contracts in an amount not to exceed $1,000,000.00 that are necessitated by the City’s response to the Coronavirus disease 2019 (COVID-19); directing the City Manager to report all contracts; approving limited term contracts for off-duty police officers to provide Municipal Court security; and declaring an emergency.

WHEREAS, on March 12, 2020, a proclamation of a state of emergency and an accompanying Order was issued to allow the City of Kansas City to take measures to reduce the possibility of exposure to COVID-19 and promote the health and safety of Kansas City residents; and

WHEREAS, on March 16, 2020, the Mayor amended his March 12th Order and disallowed gatherings with more than 10 people, closed the schools, limited restaurants and taverns to carry out, prohibited visits to nursing homes, and encouraged businesses to allow non-essential personnel to work from home; and

WHEREAS, on March 21, 2020, the Mayor issued an Amended Proclamation and a Second Amended Order that required citizens to stay at home except for essential activities and shut down non-essential businesses and non-essential operations; and

WHEREAS, the spread of COVID-19 has necessitated unprecedented health protection and containment measures in the City of Kansas City, regionally, and across the nation; and

WHEREAS, these containment measures, necessary to protect public health, have resulted in major disruptions to daily life and economic activity in the city and regionally; and

WHEREAS, the City is required to respond to rapidly changing conditions and environment caused by the Coronavirus disease; and

 

WHEREAS, because of nationwide supply shortages and the speed with which the City must move, the City needs the flexibility to enter sole source contracts; and

 

WHEREAS, even in an emergency, the citizens have the right to expect that any expenditure of public funds shall be reviewed and consented to by an elected official; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager and the Manager of Procurement Services are authorized to enter into any and all contracts that are necessitated by the City’s response to the Coronavirus disease 2019 (COVID-19) in an amount not to exceed $1,000,000.00. Each such contract that exceeds $400,000.00 and all professional services contracts shall require the prior written consent of the Mayor. This authorization shall be in place during the State of Emergency related to COVID-19.

 

Section 2. That the City Manager is directed to report all contracts that are necessitated by the City’s response to the Coronavirus disease 2019 (COVID-19) to the City Clerk within 48 hours of the execution thereof and the City Clerk shall post public notice of such contract within 24 hours of receiving such from the City Manager. Such notice from the Manager shall include the names of the parties to such contract, the amount thereof, the specific purpose thereof and the goods or services being obtained.

 

Section 3. That all limited term contracts for off-duty police officers to provide Municipal Court security from the passed 2020-21 Annual Budget (subfund 276620 Security Operations) are approved.

 

Section 4. That this Ordinance is a declared emergency under Section 503(a)(2) of the City Charter.
