Rezoning an area of approximately 19.06 acres generally located on the south side of Missouri Highway 152 on both sides of N.W. Prairie View Road, about 1,000 feet east of N. Congress Avenue from Districts GP-3/4 and GP-5 to District GP-3/4 and approving a development plan for the same. (13574-GP-1) (District OO)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0730, rezoning an area of approximately 19.06 acres generally located on the south side of Missouri Highway 152 on both sides of N.W. Prairie View Road, about 1,000 feet east of N. Congress Avenue, from District GP-3/4 (Regional Business/High Density Residential) and GP-5 (Medium Density Residential) to District GP-3/4 (Regional Business/High Density Residential), said section to read as follows:

 

Section 80-11A0730. That an area legally described as:

Containing a gross area of 20.75 acres, more or less.

District OO containing a net area of 19.06 acres, more or less.

 

is hereby rezoned from Districts GP-3/4 (Regional Business/High Density Residential) and GP-5 (Medium Density Residential) to District GP-3/4 (Regional Business/High Density Residential), all as shown outlined on a map marked Section 80-11A0730, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer modify N.W. Prairie View Road at its intersection with N.W. Barry Road as follows:

 

a. providing triple left turn lanes southbound from a point at the existing right-of-way line of N.W. Barry Road north 235 feet plus tapers;

 

b. providing two lanes to feed the triple left turn lanes beginning at a point 500 feet north of the right-of-way line to N.W. Barry Road plus tapers;

 

c. providing one through traffic lane beginning at a point 500 feet north of the right-of-way line to N.W. Barry Road plus taper;

 

d. providing a southbound right-turn lane on N.W. Prairie View Road at N.W. Barry Road from a point on the existing N.W. Barry Road north right-of-way line to a point 220 feet north of said right-of-way line plus tapers;

 

e. converting the existing westbound right turn lane to a free flow right-turn lane along N.W. Barry Road by providing a channelizing island and also converting the existing westbound through lane to a shared through and right turn lane;

 

f. providing two northbound through lanes and one northbound right-turn lane from a point on the existing N.W. Barry Road north right-of-way line to the first driveway north of N.W. Barry Road, transitioning to two northbound through lanes at said driveway;

 

g. providing a central two-way left-turn lane on N.W. Prairie View Road from a point 260 feet north of the existing north right-of-way line of N.W. Barry Road to a point 500 feet north of said right-of-way line plus tapers;

 

h. modifying the geometric of the triple left-turn lanes and installing plowable raised pavement markers within the intersection of N.W. Barry Road and N.W. Prairie View Road;

 

i. installing overhead lane-use signage for southbound traffic on N.W. Prairie View Road at its intersection with N.W. Barry Road; and

 

j. modifying the signal installation for the required intersection improvements as required.

 

The developer shall make these improvements as shown in the approved traffic study and in accordance with the requirements of the Missouri Department of Transportation and/or the Citys Public Works Department; whichever jurisdiction controls the improvements.

 

3. That the developer dedicate additional right of way on the west side of N.W. Prairie View Road as necessary to provide the modifications to N.W. Prairie View Road for the triple left-turn lanes, double left-turn lanes, right-turn lane and through lane in the southbound direction; two through lanes and right-turn lane in the northbound direction; and the center two-way left-turn lane as required by the Department of Public Works.

4. That the developer modify N.W. Prairie View Road between N. 86th Street and N. 86th Terrace by eliminating the existing parking lanes to provide two travel lanes for traffic in each direction as shown in the approved traffic study as required by the Department of Public Works.

5. That the developer modify N.W. Prairie View Road between N. 86th Terrace and N. 87th Street by eliminating the raised median to provide one travel lane for traffic in each direction and a center left turn lane as shown in the approved traffic study as required by the Department of Public Works.

 

6. That the developer enter in a maintenance agreement for block pavers on N.W. Prairie View Road within the street right-of-way as required by the Department of City Development and the Department of Public Works.

 

7. That the developer provide right of way and construct the internal street system as shown on the GP development plan as required by the Department of City Development.

 

8. That the developer modify and provide right of way for improvements to N.W. Prairie View Road between N. 87th Street and N. Congress Avenue as shown on the GP development plan as required by the Department of City Development.

 

9. That the developer update the previously approved macro storm drainage study for the overall development to address the development amendments along with a detailed micro study for approval prior to approval of the next plat and make necessary improvements as required by Development Services.

 

10. That the developer secure permits to construct new or reconstruct existing sidewalks, curb and gutter, storm sewers, and streetlights as necessary along all development street frontages, or submit a letter from a Missouri licensed civil engineer stating that the sidewalks, curb and gutter are in a good state of repair and meet the requirements set forth in Chapters 56 and 64, Code of Ordinances, as required by Development Services, prior to recording the plat.

 

11. That the developer submit plans for grading and siltation and erosion control to Development Services for approval prior to the commencement of any construction activities.

 

12. That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

13. That the developer provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

14. That the developer grant an Aviation Noise Easement to the City as required by the Aviation Department.

 

15. That the developer comply with the KCI Airport Height zoning restrictions and include these restrictions on the final plat and that the developer include a fair disclosure statement with any real estate transaction.

 

16. That the developer receive the approval of the Board of Zoning Adjustment for any necessary variances.

 

17. That the developer amend any previous deferral agreements to reflect current conditions and the changes due to this development plan.

 

18. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

19. That the developer extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by Development Services.

 

20. That the developer provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by Development Services.

 

21. That the developer submit covenants, conditions and restrictions to Development Services for review by the Law Department for approval for the maintenance of private open space and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

22. That the developer relocate and/or extend water mains as required by the Water Services Department.

 

23. That the developer shall subordinate to the City all private interest in the area of any right-of-way dedication as required by Development Services, and that the developer shall be responsible for all costs associated with subordination activities.

 

24. That the developer secure the approval of the Missouri Department of Transportation for any work within State right of way.

 

25. That the developer contribute $7,172.36 in lieu of parkland dedication for 60 multifamily residential units (60 units X 2.0 X .006 X $9,961.61 (year 2006) = $7,172.36) in satisfaction of Section 66-128 of the Subdivision Regulations.

26. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping, signage (including elevations), lighting (including a photometric study showing zero footcandles at the property line and no direct illumination of any right of way), location of required parking and building elevations.

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
