ORDINANCE NO. 100914

 

Amending Ordinance No. 100265 to correct the project number; accepting and releasing easements; and authorizing the City Clerk to record this ordinance and attached documents. (SD1054G)

 

WHEREAS, on April 15, 2010, the City Council passed Ordinance No. 100265 approving the final plat of Fountain Hills Eighth Plat; and

 

WHEREAS, the project number was incorrectly referenced in the title as “SD1054” and should have been referenced as “SD1054G”; and

WHEREAS, no other portion of Ordinance 100265, other than the project number, is being amended; and

 

WHEREAS, the developer has requested that additional easements be accepted and released by the City; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Ordinance No. 100265, passed on April 15, 2010, is hereby amended by correcting the project number referenced in the title to SD1054G.

 

Section 2. That the remaining sections of Ordinance No. 100265 remain in full force and effect.

 

Section 3. That various easements in Clay County, executed by the following entities, and which appear of record as the instrument number, and respective book and page numbers are hereby accepted for the purposes stated thereof:

No.11. A partial release of a Sanitary Sewer Easement granted to the City of Kansas City, Missouri, recorded in the Office of the Recorder of Deeds in Clay County, Missouri, on November 11, 2005, in Document 2005055645, in Book 5207, at Page 63, being all that part of said easement that falls within proposed Street right of way for NW Fountain Hills Drive that is being dedicated by the plat of Fountain Hills Eighth Plat and described as follows: A strip of land, 25.00 feet in width, in the Fractional Northwest Quarter of Section 3, Township 51 , Range 33, Kansas City, Clay County, Missouri, lying 12.50 feet each side of the following describe centerline: Commencing at the Southeast Corner of said Fractional Northwest Quarter, (Clay County); thence North 0°10'20" West, 934.37 feet; thence South 89°49'40" West, 763.21 feet thence North 50°23'13" West, 59.04 feet to a point on the Southeasterly right of way line of said NW Fountain Hills Drive and the Point of Beginning of the strip of land herein to be herein described: thence continuing North 50°23'13" West, 53.85 feet; thence North 23°00'14" West, 7.82 feet to a point on the Northwesterly right of way line of said NW Fountain Hills Drive and the Point of Termination of said strip of land. The outer limits of said strip of land are to be lengthened or shortened as necessary to terminate on said right of way line at said Point of Beginning and at said Point of Termination.

Section 5. That upon the effective date of this ordinance, the City Clerk is hereby directed to record copies of this ordinance, together with all other relevant documents, in the Office of the Recorder of Deeds of Clay County, Missouri.
