ORDINANCE NO. 080465
Amending Ordinance No. 960153
passed February 26, 1996, which authorized a contract with Haines-Stowers
Construction Company, Inc., to construct a sanitary sewer in the vicinity of
Missouri Highway 152 and I-35, and the Director of Public Works to expend money
for the project, and also authorizing the assessment of costs against the
benefiting properties in Sewer Districts Nos. 25007 through 25021, by repealing
and reenacting Section 12 thereof and changing the number of annual
installments.
WHEREAS, repealing
Section 12 will correct a clerical error; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
Ordinance No. 0960153 passed February 26, 1996, which authorized the assessment
against the benefited properties in Sewer District Nos. 25007 through 25021, is
hereby amended by repealing Section 12 thereof, and enacting in lieu a new
section of like subject reducing the number of annual installments:
Section 12. That
special assessments for the cost of the sewer improvement are hereby authorized
to be made and levied upon the lands within Sewer District Nos. 25007 through
25021 according to the area rule and according to the provisions of the Code of
Ordinances relating thereof. Special tax bills evidencing the amount of such assessments
shall be issued to Kansas City and shall be credited to the Sewer Special
Assessment Fund and, when collected, the proceeds thereof shall be returned to
and become a part of the said Fund. The said tax bills shall be made payable in
fifteen annual installments at such times and with such effect as is provided
in the Code of Ordinances. The said special assessments shall bear interest at
a rate per annum equal to the rate of ten year United States treasury notes as
established at the last auction before the assessment is certified to the
Director of Finance. If delinquent, said special assessments shall bear
interest at a rate per annum two percent higher than the interest rate on
assessments which are not delinquent.
Section 2. That
all sections of Ordinance No. 960153 not repealed and reenacted above shall
remain effective.
