SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 100727

 

Vacating the east-west alley north of Armour Boulevard between Warwick Street and Gillham Road, Kansas City, Jackson County, Missouri, and directing the City Clerk to record certain documents; establishing recording conditions and an effective date. (1614-V)

 

 BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. The Council of Kansas City does hereby find and declare that on the 11th day of September, 2009, a petition was filed with the City Clerk of Kansas City by the Apartments of Bellerive, L.L.C., for the vacation of the east-west alley next north of Armour Boulevard from the east line of Warwick Boulevard, as now established, to the west line of Gillham Road, as now established, and all utility easements over, under, across and along said alley, all in Section 17, Township 49 North, Range 33 West, Kansas City, Jackson County, Missouri, giving the distinct description of the alley to be vacated, and also the names of the persons and corporations owning or claiming to own the property fronting thereon, and that due notice of the pendency of said petition has been given in the newspaper doing the city printing, and that the consent of the persons and corporations owning or claiming to own three-fourths of the front feet of the property immediately adjoining said alley has been obtained in writing, that said consent has been acknowledged as deeds are acknowledged, and was duly filed with the petition for such vacation in the City Clerk's Office.

 

Section 2. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.

 

 

 

 

Section 3. That the Council finds that no private rights will be unreasonably injured or endangered by this vacation and that the public will suffer no unreasonable loss or inconvenience thereby.

 

Section 4. That the east-west alley next north of Armour Boulevard from the east line of Warwick Boulevard, as now established, to the west line of Gillham Road, as now established, and all utility easements over, under, across and along said alley, all in Section 17, Township 49 North, Range 33 West, Kansas City, Jackson County, Missouri, be and the same is hereby vacated.

 

Section 5. This ordinance shall not be recorded until the Cabrera property (the south 33 feet of lot 32, Chadwick’s Second Addition) comes into common ownership with any property abutting the Cabrera property which has street frontage, and until the documents transferring property into the common ownership have been recorded. The City Attorney shall deliver notice to the City Clerk of the recordation of said documents, and within twenty days of receiving such notice, the City Clerk shall acknowledge this ordinance as deeds are acknowledged and cause this Ordinance to be recorded in the office of the Recorder of Deeds of Jackson County, Missouri.

 

Section 6. This Ordinance shall become effective ten (10) days after passage or upon recordation of this ordinance, whichever last occurs. Provided, however, if this ordinance is not recorded on or before December 31, 2010, this Ordinance shall become null and void and of no further force and effect.

 

Section 7. All Ordinances or parts of Ordinances in conflict with this Ordinance are, in so much as they conflict with this Ordinance, hereby repealed.
