COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 190485, AS AMENDED

 

Directing the City Manager to issue a Request for Information and a Request for Proposals/Qualifications for the design, construction, operation and maintenance of a new 12-field soccer complex in the City’s Northland; authorizing the Director of Finance to close project accounts; declaring the intent of the City to reimburse itself from the bond proceeds for certain expenditures and recognizing that this ordinance has an accelerated effective date.

 

WHEREAS, Resolution No. 190192 directed the City Manager to investigate potential sources of funding for the development of a new Northland youth soccer/multi-sport field complex; and

 

WHEREAS, the City Manager has identified the source of funds to proceed with the development of a new 12-field soccer complex in the City’s Northland; and

 

WHEREAS, through the issuance of a RFI and subsequent RFP/Q, the City can identify a sound development strategy that best maximize its resources; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is hereby directed to allocate available funds from the following sources for the design, construction, operation and maintenance of a 12-field soccer complex in the City’s Northland according to the following order of priority:

 

a.       Incremental economic activity taxes from the KCI Corridor TIF to be exhausted before using the funds listed under subsections b, c and d.

b.      Second District In-District (Neighborhood) Capital Improvements Sales Tax.

c.       Capital Improvements Sales Tax from expiring TIFs North of the River.

d.      Parks Sales Tax from expiring TIFs North of the River.

 

Section 2. That the City Manager is hereby directed to issue a Request for Information and a Request for Proposals/Qualifications for the design, construction, operation and maintenance of the Northland soccer complex.

 

Section 3.  That the selected developer shall identify and acquire the land necessary for the Northland soccer complex.

 

Section 4. That the City Manager is hereby directed to take all necessary administrative steps to make the aforementioned sources identified in Section 1 available to pay principal and interest on a not to exceed $42,000,000.00 special obligation bond issue secured by the City for the completion of the project for a period not to exceed 20 years.

 

Section 5. That prior to the execution of a contract with a selected developer, the City Manager is directed to present to Council a financing plan identifying the specific sources of funding including Second District In-District PIAC allocation in the amount of $250,000.00 per year for four years subject to all Code requirements and authorizing ballot language.

Section 6. That the City Manager is authorized to conceive and negotiate a Development Agreement for the operation of the soccer program subject to final review and approval of the City Council.

Section 7. The Director of Finance is hereby authorized to close project accounts, encumbrances, and retainage and return any unspent portion to the Fund Balance from which it came upon the earliest of: (i) the Project’s completion; (ii) final maturity of financing; or (iii) five years after issuance. 

Section 8. That the City hereby declares its official intent to reimburse itself for certain expenditures made within sixty (60) days prior to or on and after the date of this ordinance with the proceeds of bonds expected to be issued by the City. The maximum principal amount of bonds expected to be issued for the appropriations shall not exceed $42,000,000.00. This constitutes a declaration of official intent under Treasury Regulation Section 1.150-2.

 

Section 9. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(D) of the Charter, and shall take effect in accordance with Section 503, City Charter.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
