ORDINANCE NO. 970566

 

Vacating a portion of Wyandotte Street lying south of 12th Street and adjoining Lot 12, Block B of "Resurvey of Reids Addition" and all utility easements over, under, along and across said street, in Kansas City, Jackson County, Missouri. (1235-V)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. The Council of Kansas City does hereby find and declare that on the 3rd day of February, 1997, a petition was filed with the City Clerk of Kansas City by Landmark Hotel Company for the vacation of all that part of the Wyandotte Street right of way, as said street is now established, situated in the Northwestern Quarter of Section 5, Township 49, Range 33 in Kansas City, Jackson County, Missouri, being more particularly described as follows: Beginning at the point of intersection of the south right of way line of 12th Street, as now established with the east right of way line of said Wyandotte Street; thence south along said east right of way line and along the west line of Lot 12, Block B of the Resurvey of Reids Addition, a subdivision in said city, county and state, according to the recorded plat thereof, a distance of 137.26 feet (135' Plat) to the southwest corner of said Lot 12 and a point of intersection of said east right of way line with the north line of an east-west alley; thence west along the westerly prolongation of said north line; a distance of 2.12 feet; thence north along a straight line, deflecting 89 49'56" to the right from the last described course, a distance of 137.25 feet; thence east, perpendicular to the last described course, a distance of 1.0 feet to the point of beginning and all utility easements over, under, along and across said street, giving the distinct description of the street to be vacated, and also the names of the persons and corporations owning or claiming to own the property fronting thereon, and that due notice of the pendency of said petition has been given for twenty (20) days in the newspaper doing the city printing, and that the consent of the persons and corporations owning or claiming to own three-fourths of the front feet of the property immediately adjoining said street has been obtained in writing, that said consent has been acknowledged as deeds are acknowledged, and was duly filed with the petition for such vacation in the City Clerk's Office.

 

Section 2. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.

 

Section 3. That all that part of the Wyandotte Street right of way, as said street is now established, situated in the Northwestern Quarter of Section 5, Township 49, Range 33 in Kansas City, Jackson County, Missouri, being more particularly described as follows: Beginning at the point of intersection of the south right of way line of 12th Street, as now established with the east right of way line of said Wyandotte Street; thence south along said east right of way line and along the west line of Lot 12, Block B of the Resurvey of Reids Addition, a subdivision in said city, county and state, according to the recorded plat thereof, a distance of 137.26 feet (135' Plat) to the southwest corner of said Lot 12 and a point of intersection of said east right of way line with the north line of an east-west alley; thence west along the westerly prolongation of said north line; a distance of 2.12 feet; thence north along a straight line, deflecting 89 49'56" to the right from the last described course, a distance of 137.25 feet; thence east, perpendicular to the last described course, a distance of 1.0 feet to the point of beginning and all utility easements over, under, along and across said street, be and the same is hereby vacated.

 

Section 4. That the City Clerk of Kansas City, Missouri, be and she is hereby authorized and directed to acknowledge this ordinance as deeds are acknowledged, and to cause this ordinance and the consent of property owners hereinbefore referred to, to be filed for record in the Recorder's Office in Jackson County, Missouri.

 

Section 5. All Ordinances or parts of Ordinances in conflict with this Ordinance are, in so much as they conflict with this Ordinance, hereby repealed.
