Approving the preliminary plat of
Plaza 47 Condominiums on a .24 acre tract of land generally located on west
side of Belleview Avenue. (SD 1178)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat of Plaza 47 Condominiums on a .24 acre tract of land
generally located on west side of Belleview Avenue, and more specifically
described as follows:
Lots 114 and 115, PENN PARK, a subdivision in Kansas City,
Jackson County, Missouri, described as follows: Beginning at the Northeast
corner of said Lot 114; thence South 0229'43"
West along the East line of said Lots 114 and 115 a distance of 80.03 feet to
the Southeast corner of said Lot 115; thence North 8723'15" West along
the South line of said Lot 115 a distance of 132.24 feet to the Southwest
corner of said Lot 115; thence North 0229'43" East along the West line of said
Lots 114 and 115 a distance of 80.03 feet to the Northwest corner of said Lot
114; thence South 8723'15" East along the North line of said
Lot 114 a distance of 132.24 feet to the point of beginning, containing 10,583
square feet (0.24 acre), more or less.
is hereby approved, subject to
the following conditions:
1. That the developer shall cause the area to be platted and
processed in accordance with Chapter 66, Code of Ordinances of the City of
Kansas City, Missouri, commonly known as the Subdivision Regulations.
2. That the developer secure permits to repair sidewalks, curbs,
and gutters as necessary along all development street frontages as required by
the Department of Public Works in accordance with Chapters 56 and 64 of the
Code, prior to recording of the plat.
3. That the developer submit covenants, conditions and
restrictions to the Law Department for approval for the maintenance of common
areas and private open space tracts.
4. That the developer obtain necessary variance from the Board
of Zoning Adjustment for minimum lot area required for residential condominium
units and from minimum parking requirements.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Subdivision Regulations have been given and had.
