ORDINANCE NO. 041362

 

Authorizing an amendment to a Lease Agreement with Care Center of Kansas City for property generally known as Swope Ridge Geriatric Center at 5900 Swope Parkway for the term beginning May 1, 2004 and ending April, 30, 2008.

 

WHEREAS, the third amendment to Lease Agreement (Third Amendment) by and between the City of Kansas City, Missouri, hereinafter designated as Lessor, and Care Center of Kansas City (Swope Ridge Geriatric Center), a Missouri , hereinafter designated as Lessee, takes effect May 1, 2004; and

 

WHEREAS, the Lessor and the Lessee entered into a Lease Agreement dated October 4, 1990 (Lease Agreement), for certain parcels of property generally known as Swope Ridge Geriatric Center, 5900 Swope Parkway, Kansas City, Jackson County, Missouri 64130; and

 

WHEREAS, the Kansas City Municipal Assistance Corporation issued its Improvement and Refunding Bonds, Series 1992B, in part to provide funds to the Lessor for the purpose of constructing and installing certain improvements on the Property and acquiring and installing certain furnishings and equipment therein; and

WHEREAS, the provision of such financing required certain adjustments to the lease term and rental provisions contained in the Lease Agreement, which were set forth in two separate Lease Agreement Amendments, the most recent dated December 27, 1998; and

 

WHEREAS, it is now necessary that further adjustments to the rental provisions be made in order to accommodate the cash flow needs of the Lessee, who provides services for the elderly; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That for and in consideration of the premises, and the mutual covenants herein contained, the Lessee and Lessor agree that the term of the Lease shall begin on the 1st day of May, 2004, and end on the 30th day of April, 2008. Contractor shall pay the following sums:

 

May 1, 2004 April 30, 2005 179,493.00

May 1, 2005 April 30, 2006 180,565.00

May 1, 2006 April 30, 2007 180,883.00

May 1, 2007 April 30, 2008 180,425.00

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
