RESOLUTION NO. 200380

 

Directing the City Manager to implement procedures to expedite permit applications for sidewalk and street cafés and to provide guidance to applicants regarding design requirements while considering the current State of Emergency.

 

WHEREAS, in December 2019, a novel coronavirus, the virus that causes the disease COVID-19, was detected in Wuhan, China; and

 

WHEREAS, on March 11, 2020, the World Health Organization declared COVID-19 a global pandemic; and

 

WHEREAS, on March 12, 2020, a proclamation of a state of emergency was issued to allow the City of Kansas City to take measures to reduce the possibility of exposure to COVID-19 and promote the health and safety of Kansas City residents; and

 

WHEREAS, the COVID-19 virus spreads between people who are in close contact with one another through respiratory droplets produced when an infected person coughs or sneezes; and

 

WHEREAS, the City wishes to employ all means available under the law to protect public life, health safety and property to limit the development, contraction and spread of COVID-19 creating this emergency; and

 

WHEREAS, on May 11, 2020, Mayor Lucas announced a phased reopening of the city that would limit restaurants and bars to ten percent of their typical occupancy; and

 

WHEREAS, the City wishes to resume some level of economic activity and for hospitality workers to return to their jobs; and

 

WHEREAS, Committee Substitute for Ordinance No. 190953, As Amended, gave the authority to the Director of the Public Works Department to issue permits for new sidewalk cafes, parklets and street cafes; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

That in consideration of the current State of Emergency and in an effort to assist businesses desiring to apply for new sidewalk and street café permits, the City Manager is hereby directed to:

 

·         Make every effort to expedite applications for sidewalk and street cafe permits; and

 

·         Relax sidewalk and street cafe design requirements, where feasible, while ensuring safety and unencumbered pedestrian space; and

 

·         Provide applicants with clear and reasonable design guidance utilizing inexpensive and impermanent construction materials where feasible.
