ORDINANCE NO. 100536

 

Approving the preliminary plat of 1612 Jefferson for four multifamily residential condominium units in one existing building on about 0.14 acres in District R-4 generally located at 1612 Jefferson Street. (SD 1413)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of 1612 Jefferson for four multifamily residential condominium units in one existing building on about 0.14 acres in District R-4 (Low Apartment) generally located at 1612 Jefferson Street, and more specifically described as follows:

 

The east 128.00 feet of Lots 12 and 13, except that part of said Lots 12 and 13 taken for alley, by Ordinance No. 21779, approved December 6, 1881, all in Block 4, King & Bouton's Addition, a subdivision in the City of Kansas City, Jackson County, Missouri.

 

The above description has been prepared by Anderson Survey Company, and is a compilation of information contained in a Missouri Warranty Deed filed as Document No. 2008E0109036 and Ordinance No. 21779, approved December 6, 1881.

 

The above description contains 6,216 square feet or 0.143 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer submit a letter from a licensed civil engineer, licensed architect, or licensed landscape architect, who is registered in the State of Missouri, stating the condition of the sidewalks, alleys, curbs, and gutters. The letter must identify state of repair as defined in Chapters 56 and 64, Code of Ordinances, for the sidewalks, alleys, curbs, and gutters. It shall identify the quantity and location of sidewalks, alleys, curbs, and gutters that need to be constructed, repaired, or reconstructed. The developer shall secure permits to repair or reconstruct the identified sidewalks, curbs, and gutters as necessary along all development street frontages, as required by Development Services, prior to recording the plat.

 

3.                  That the developer submit covenants, conditions and restrictions to Development Services for approval by the Law Department for the maintenance of common elements, prior to recording the plat.

 

4.                  That the developer provide a plat drawing that meets Chapter 52, or that the developer obtain a certificate of legal non-conforming use, as required by City Development.

 

5.                  That the developer be granted approval for any required variances from the Board of Zoning Adjustment.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
