COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 160267

 

Estimating revenue in the amount of $1,395,256.00 in the Capital Improvement Fund; appropriating that amount to the Route 152 Trail Segment 8 and 9 account; authorizing the Director of Public Works to execute an amended and restated funding agreement with the Tax Increment Financing Commission; authorizing a contract with Pyramid Excavation and Construction, Inc. for approximately $1,537,000 for Route 152 Trail Segments 8 and 9, Fed No. STP-3400 (437); designating requisitioning authority; and recognizing this ordinance as having an accelerated effective date.

WHEREAS, Ordinance Nos. 120924 and 140182 directed the City Manager to cause specific projects to be submitted to the Mid-America Regional Council (MARC) as applications for federal Transportation Alternatives Program (TAP) funding; and

 

WHEREAS, the City received $1,000,000.00 of TAP funding for extension of the Route 152 Trail from Line Creek Parkway to U.S. Highway 169, known as Route 152 Trail Segments 8 and 9, Federal Project STP-3400(437); and

 

WHEREAS, funding from the KCI Corridor Tax Increment Financing Plan provided a portion of the local match required to utilize the $1,000,000.00 federal grant; and

 

WHEREAS, Ordinance No. 140907 approved the Fifteenth Amendment to the KCI Corridor Tax Increment Financing Plan to provide funding for the construction of trail segments which included the segment of the Route 152 Trail from Line Creek Parkway to US 169; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the revenue in the following accounts of the Capital Improvements Fund is estimated in the following amounts:

 

16-3090-890001-485380-89020227 Contribution from TIF Commission $ 395,256.00

16-3090-890001-477777-89020227 STP Grant-Route 152 Trail 1,000,000.00

TOTAL $1,395.256.00

 

Section 2. That the sum of $1,395,256.00 is appropriated from the Unappropriated Fund Balance of the Capital Improvement Fund to the following account in the Capital Improvement Fund:

 

16-3090-898207-B-89020227 Route 152 Trail Segment 8 and 9 $1,395,256.00

 

Section 3. That the Director of Public Works is authorized to execute an amended and restated funding agreement with the Tax Increment Financing Commission for the purpose of providing funding for the construction of the Route 152 Trail. The agreement is approved in substantial form as that on file in the office of the Director of Public Works, subject to the receipt of all required approvals.

 

Section 4. That the Director of Public Works is hereby authorized to execute a $1,536,870.00 contract with Pyramid Excavation and Construction, Inc. for Project No. 89020227 Route 152 Trail from funds hereby and previously appropriated to Account No. 16-3090-898207. A copy of the contract is on file in the office of the Director of Public Works and is incorporated herein by reference.

 

Section 5. That the Director of Public Works is hereby designated requisitioning authority for Account No. 16-3090-898207.

Section 6. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(D) of the City Charter and shall take effect in accordance with Section 503, City Charter.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
