ORDINANCE NO. 970455

 

Amending Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 80-11A0046, rezoning an area of approximately 37.19 acres generally bounded by 47th Street on the north, Troost Avenue on the east, Brush Creek on the south and Locust Street on the west from Districts R-2a (Two-Family Dwellings), R-4 (Low Apartments), and C-3a2 (Intermediate Business, High Buildings) to District R-5-o-p (High Apartments, Administrative Office Building - Limited District), and approving a preliminary plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0046, rezoning an area of approximately 37.19 acres generally bounded by 47th Street on the north, Troost Avenue on the east, Brush Creek on the south and Locust Street on the west from Districts R-2a (Two-Family Dwellings), R-4 (Low Apartments), and C-3a2 (Intermediate Business, High Buildings) to District R-5-o-p (High Apartments, Administrative Office Building - Limited District), said section to read as follows:

 

Section 80-11A0046. That an area legally described as:

 

A tract of land in Lahoma, Fairland, Rockhill, and Amended Plat of Rockhill, subdivisions in the City of Kansas City, Jackson County, Missouri, described as follows: Beginning at the northeast corner of Lot 17, Block 1, Lahoma, thence South 04 40'08" West along the easterly line of Lots 14 thru 17, Block 1, and Lots 1 thru 13, Block 2, Lahoma and the westerly line of Troost Street, 985.55 feet to a point 31.78 feet north of the southeast corner of Lot 14, Block 2, Lahoma; thence southwesterly along a curve concave to the left having an initial tangent bearing of South 89 30'44" West and a radius of 495.00 feet, an arc length of 172.44 feet; thence southwesterly along a curve concave to the right with a radius of 780.00 feet an arc length of 340.84 feet; thence North 85 24'37" West, 331.81 feet (deed 331.82 feet); thence northwesterly along a curve concave to the right having a radius of 330.00 feet an arc length of 230.49 feet; thence North 45 23'33" West 348.71 feet; thence northwesterly along a curve concave to the left having a radius of 270.00 feet an arc length of 170.04 feet to a point on the east right of way of Rockhill Road; thence North 89 08'56" West, 108.58 feet to a point on the west right of way of Rockhill Road; thence North 83 45'19" West 52.26 feet; thence South 06 14'41" West 64.63 feet; thence North 89 05'39" West 288.36 feet to a point on the easterly right of way line of Locust Street; thence North 04 24'37" East along the easterly right of way of Locust Street 512.05 feet to the southerly right of way of Pierce Street; thence South 85 38'15" East along the southerly right of way of Pierce Street, 377.00 feet to the easterly right of way of Rockhill Road; thence South 85 42'10" East 90.10 feet to the easterly right of way line of Rockhill Road; thence North 06 17'38" East along the easterly right of way of Rockhill Road, 107.17 feet; thence northeasterly along a curve concave to the right having a radius of 941.83 feet, an arc length of 85.01 feet to a point on the southerly right of way line of 47th Street Terrace; thence South 85 44'19" East along the southerly right of way line of 47th Street Terrace and its easterly prolongation 192.01 feet to the easterly right of way of Holmes Street; thence North 04 36'54" East along the easterly right of way line of Holmes Street, 115.94 feet to the northwest corner of Lot 7, Block 4, Fairland; thence South 85 38'55" East along the north line of Lots 7 and 26, Block 4, Fairland, Lots 7 and 26, Block 1, Fairland, Lots 7 and 23, Block 4, Lahoma, and Lots 7 and 17, Block 1, Lahoma, 1253.71 feet to the point of beginning. Excepting from the above described tract that part lying in Rockhill Road right of way. The above described tract contains 37.19 acres or 1620061.83 square feet more or less.

 

is hereby rezoned from Districts R-2a (Two-Family Dwellings), R-4 (Low Apartments), and C-3a2 (Intermediate Business, High Buildings) to District R-5-o-p (High Apartments, Administrative Office Building - Limited District), all as shown outlined on a map marked Section 80-11A0046, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval when the first plat is submitted and that the

developer make any improvements as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer provide for fire protection as required by the Fire Department.

 

5. That the developer extend water mains as required by the Water Services Department.

 

6. That the developer extend sanitary sewers as required by the City Engineer's Office.

 

7. That the developer obtain a floodplain certificate prior to working within the floodplain.

 

8. That the developer contribute $159,729.00 to the Plaza Environs Improvement Fund based on a rate of $1.00 per gross square foot for office.

 

9. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

10. That the developer provide a public access easement along Brush Creek from the end of vacated Harrison Avenue east to Troost Avenue as required by the Department of

Public Works..

 

11. That the developer provide a maintenance access easement to the City for Brush Creek as required by the Board of Parks and Recreation Commissioners; said

easement to be located near vacated Harrison Avenue extending along Brush Creek

and also along the main Troost project entrance.

 

12. That the developer reconstruct the vacated roadways of Harrison, Campbell and Charlotte between 47th Street and the north project line as required by the

Department of Public Works in order to give the appearance of a private drive.

 

13. That the developer install, repair or replace the frontage walkways along Rockhill Road and Troost Avenue as required by the Department of Public Works.

 

14. That the developer provide an updated traffic study to the Department of Public Works for approval prior to the platting of any lot and that the developer make any

necessary improvements as required by the approved traffic study.

 

15. That the developer submit a final plan to the City Plan Commission for approval, including plans for signage, landscaping and screening.

 

A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 970455, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
