ORDINANCE NO. 950457

 

Approving the preliminary plat of Whispering Creek on a 5.03 acre tract of land located east of N. Stark Avenue at N.E. 73rd Terrace. (SD 0692)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Whispering Creek on a 5.03 acre tract of land located east of N. Stark Avenue at N.E. 73rd Terrace, and more specifically described as follows:

 

A tract of land lying in the Southwest Quarter of Section 14, Township 51, Range 32, Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the southwest corner of said Southwest Quarter; thence North 1 16'49" East, along the west line of said Southwest Quarter 673.00 feet to the true point of beginning of the tract to be herein described, said point being also the northwest corner of North Church Estates, a subdivision of land in Kansas City, Clay County, Missouri; thence North 1 16'49" East, along said east line, 336.73 feet to the southwest corner of South Oaks Court, a subdivision of land in Kansas City, Clay County, Missouri; thence South 89 27'53" East, along the south line of said South Oaks Court, 649.72 feet to the southeast corner of said South Oaks Court; thence South 0 43'53" West, 336.73 feet to a point on the north line of said North Church Estates; thence North 89 27'45" West, along said north line, 652.95 feet to the true point of beginning. Containing 5.03 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer contribute $238.00 per unit for the I-35/Liberty Corridor Study Area.

 

3. That the developer submit a storm drainage study to the City Engineer's Office for approval including provision for any needed improvements.

 

4. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to the commencement of any construction

activities.

 

5. That the developer secure the approval of the Street Naming Committee for all streets.

 

6. That the developer provide fire protection and hard-surface roads prior to construction beyond foundations.

 

7. That the developer provide for fire protection as required by the Fire Department.

 

8. That the developer extend water mains as required by the Water Department.

 

9. That the developer extend sanitary sewers as required by the Pollution Control Department.

 

10. That the developer pay money in lieu of parkland dedication in the amount of $4,408.16 for 19 lots in satisfaction of Section 66-128, Code of Ordinances.

 

11. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area for the entire development exceeds five

acres.

 

12. That the developer dedicate right of way to ensure 30 feet as measured from centerline of N. Stark Avenue.

 

13. That the developer improve one-half of N. Stark Avenue to collector street standards, including sidewalks and streetlights.

 

14. That the developer submit a street tree planting plan as approved by the City Forester with the final plat.

 

15. That a variance to the 3:1 lot depth to width be granted for Lots 12-17.

 

a copy of said preliminary plat is on file in the office of the City Clerk under Document No. 950457, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
