ORDINANCE NO. 051298

 

Annexing approximately 17.338 acres generally located at the northwest corner of N.E. 104th Street and Missouri Route A Highway which is being concurrently detached from the City of Liberty for annexation by the City of Kansas City and directing the City Clerk to file certified copies of this ordinance with the required Clay County officials. (100-AN-4)

 

WHEREAS, the Hosanna Lutheran Church and Robert L. Fleshman, President of F&F Management, Inc. are developing property located on the west side of Missouri Route A, north of N.E. 104th Street, the majority of which is located in Kansas City, but a small portion is currently located within the City of Liberty; and

 

WHEREAS, this action will allow the existing church currently located within Liberty to be expanded into Kansas City, and also to allow all of F&F Management property to be developed within one municipality and derive all municipal services from one municipality; and

 

WHEREAS, the City of Kansas City and the City of Liberty agree that services to the small portion of both properties not currently located within Kansas City would be more efficiently provided by Kansas City; and

 

WHEREAS, the property to be concurrently annexed by Kansas City and detached by Liberty abuts Kansas City; and

 

WHEREAS, both Hosanna Lutheran Church officials and Robert L. Fleshman, President, F&F Management, Inc., consent to this concurrent detachment and annexation; and

 

WHEREAS, all provisions of Section 71.011, Revised Statutes of Missouri, authorizing such concurrent detachment and annexation have been met; NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. Annexation and Detachment of Property. That the following property, generally located at the northwest corner of N.E. 104th Street and Missouri Route A Highway, and more specifically described as:

 

A tract of land in the Northeast Quarter of Section 36, Township 52, Range 32, and the Southeast Quarter of Section 25, Township 52, Range 32,in Liberty, Clay County, Missouri, being more particularly described as follows: Commencing at the Northeast corner of said Northeast Quarter of said Section 36, said point being also the Southeast corner of said Southeast Quarter; thence North 89 degrees 31 minutes 22 seconds West (Bearings are by Deed recorded in Book 2602, Page 611) along the North line of said Northeast Quarter, being also the centerline of Gashouse Road, also known as N.E. 104th Street, a distance of 36.15 feet to a point on the West Right-of-Way line of Route A, also known as Missouri Route C, as established, 35 feet from the centerline of said Right-of-Way, said point being also the True Point of Beginning of this tract; thence South 0 degrees 14 minutes 54 seconds West along said West line, a distance of 25.00 feet; thence North 89 degrees 31 minutes 22 seconds West, 25 feet South of and parallel to the North line of said Northeast Quarter, being also the South line of said Southeast Quarter, a distance of 2602.67 feet to a point on the West line of said Northeast Quarter, said line being also the existing West City limits line of said Liberty, Missouri, and the existing East City limits line of Kansas City, Missouri; thence North 0 degrees 29 minutes 09 seconds West along said lines, a distance of 25.00 feet to the Northwest corner of said Northeast Quarter, being also the Southwest corner of said Southeast Quarter; thence South 89 degrees 31 minutes 22 seconds East along the North line of said Northeast Quarter and the South line of said Southeast Quarter, being also the existing North City limit line of said Liberty, Missouri and the existing South City limit line of said Kansas City, Missouri, a distance of 2338.80 feet to a point on the existing West City limit line of said Liberty, Missouri and the existing East City limit line of said Kansas City, Missouri; thence North 0 degrees 22 minutes 35 seconds East, 300 feet West of and parallel to the East line of said Southeast Quarter, being also the West City limit line of said Liberty, Missouri and the East City limit line of said Kansas City, Missouri, a distance of 2640.44 to a point on the North line of said Southeast Quarter; thence leaving said City limits lines, South 89 degrees 47 minutes 08 seconds East, along the North line of said Northeast Quarter, a distance of 258.38 feet to a point on the West Right-of-Way line of said Route A, said line being 35 feet West of the Centerline of said Right-of-Way, and 41.62 feet West of the Northeast corner of said Southeast Quarter; thence South 0 degrees 14 minutes 54 seconds West along said West line, a distance of 2504.01 feet to an angle point in said Right-of-way line; thence continuing along said West line, South 0 degrees 25 minutes 54 seconds West, a distance of 137.63 feet to the point of beginning, containing 755,227 square feet, or, 17.3376 acres, more or less.

 

is hereby declared to be annexed by the City of Kansas City effective upon the simultaneous and concurrent detachment of this property by the City of Liberty.

 

Section 2. Reason and Purpose for the Detachment and Annexation. That this concurrent annexation by the City of Kansas City and detachment by Liberty will allow Kansas City to provide services to the property and not require two municipalities to provide services to one area, and it will place all of N.E. 104th Street within the city limits of Kansas City, thus benefiting the citizens of both municipalities.

 

Section 3. Filing. That the City Clerk will file a certified copy of this ordinance and a certified copy of the related detachment ordinance adopted by the City of Liberty in the office of the County Clerk of Clay County, the Recorder of Deeds of Clay County, and the Clerk of the Circuit Court of Clay County.
