ORDINANCE NO. 010126
Approving
a Community Unit Project on an approximately 1.9 acre tract of land generally located
at the southeast corner of Ward Parkway and Summit Street. (9565-CUP-4)
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That a Community Unit Project on an approximately 1.9 acre tract of land
generally located at the southeast corner of Ward Parkway and Summit Street,
and more specifically described as follows:
A replat and subdivision of all of Lots 1
through 6, inclusive, Sunset Wood, a subdivision in the Southeast Quarter of
Section 30, Township 49, Range 33, Kansas City, Jackson County, Missouri, being
bounded and described as follows: Commencing at the northwest corner of the
Southeast Quarter of said Southeast Quarter; thence South 02E32'11" West along the west line of
the Southeast Quarter of said Southeast Quarter, 62.57 feet to a point on the
southerly right of way line of Ward Parkway, as now established, said point
being also the true point of beginning of the tract to be herein described;
thence North 69E10'57" East along
said southerly line, 324.27 feet; thence South 27E13'48" East along said southerly line,
81.38 feet to a point on the northerly right of way line of Sunset Drive, as
now established; thence South 52E39'12"
West along said northerly line, 363.36 feet; thence westerly along said
northerly line and the northerly line of Summit Street, as now established, on
a curve to the right, tangent to the last described course, having a radius of
50.00 feet, a central angle of 44E25'06",
an arc distance of 38.76 feet; thence North 82E55'42" West along said northerly line,
29.94 feet; thence westerly along said northerly line, on a curve to the left,
tangent to the last described course, having a radius of 120.00 feet, a central
angle of 08E38'36", an arc
distance of 18.10 feet; thence South 88E25'42"
West, along said northerly line, 119.23 feet; thence northwesterly along said
northerly line, on a curve to the right, tangent to the last described course,
having a radius of 90.00 feet, a central angle of 70E45'15", an arc distance of 111.14
feet; thence North 20E49'03" West along
said northerly line, 35.00 feet to a point on the aforementioned southerly line
of said Ward Parkway; thence North 69E10'57"
East along said southerly line, 268.54 feet to the true point of beginning.
Containing 1.87 acres, more or less.
is
hereby approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study for the entire development to the
City Engineers Office for approval and that the developer construct any
improvements as required by the City Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineer's Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Department of Public Works
prior to beginning any construction, grading, clearing or grubbing activities,
if the disturbed area exceeds one acre.
5. That
the developer improve the north half of Summit Street to residential street
standards as required by the Department of Public Works, including construction
of sidewalks and installation of streetlights.
6. That
the developer improve the north half of Sunset Drive to residential street
standards as required by the Department of Public Works, including construction
of sidewalks and installation of streetlights.
7. That
the developer construct/reconstruct sidewalks on the south half of Ward Parkway
as required by the Board of Parks and Recreation Commissioners.
8. That
the developer extend sanitary sewers as required by the Department of Public
Works.
9. That
the developer show the limits of the floodplain on the final plat as required
by the Department of Public Works.
10. That
the developer secure a floodplain certificate from the Department of Codes
Administration prior to beginning any construction activities within the
floodplain.
11. That
the developer contribute $1,706.47 in lieu of parkland dedication for 6
single-family units (3.7 x .006 x $12,811.37) in satisfaction of Section 66-128
of the Subdivision Regulations.
12. That
the developer submit a street tree planting plan as part of the final plat with
a copy to be submitted to the Department of City Development, secure the
approval of the City Forester for street trees planted on right of way in front
of residential lots, and plant the street trees in conformance with the plan
approved by the City Forester. The plan shall include size, type, species and
placement of trees.
13. That
the developer receive the approval of the Board of Zoning Adjustment for any
necessary front yard setback or fence height variances.
14. That
the developer submit a final plan to the City Plan Commission for approval
including detailed information on landscaping, signage (include elevations) and
building elevations.
A
copy of said Community Unit Project plan is on file in the office of the City
Clerk under Document No. 010126, which is attached hereto and made a part
hereof.
Section
B. That the Council finds and declares that before taking any action on the
proposed Community Unit Project hereinabove, all public notices have been given
and hearings have been held as required by the Zoning Ordinance.
