COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 130486

 

Amending the 2013 One Year Action Plan; estimating revenue in the amount of $238,008.00 and appropriating funds in the amount of $1,181,950.00 in the Community Development Block Grant (CDBG) Fund; reducing revenue of $4,890,138.00 and appropriations of $3,135,159.00 in the Home Investment Fund; reducing revenue and appropriations in the amount of $109,131.00 for the Emergency Solutions Grant (ESG) in the General Fund; authorizing the Director of Neighborhoods and Housing Services to enter into contract amendments; and approving Amendment No. 1 to the 2013 One Year Action Plan and authorizing submission of said Amendment to the U.S. Department of Housing and Urban Development for its consideration.

WHEREAS, the City of Kansas City, Missouri was notified on May 30, 2013 that it has been allocated $7,638,008.00 in CDBG funding, $1,810,408.00 in HOME funding, $550,869.00 in ESG funding and $1,055,457.00 in HOPWA funding from HUD to be used toward eligible housing and community development activities; and

 WHEREAS, on January 13, 2013, Council approved the City’s One Year Action Plan through Committee Substitute for Resolution No. 121077 and submitted said Plan to the U.S. Department of Housing and Urban Development (HUD); and

WHEREAS, the submitted Plan was based upon estimated funding levels for the CDBG and HOME programs that were lower than the amounts actually allocated by HUD and an estimated funding level for the HOPWA and ESG programs that was higher than the amount actually allocated by HUD; and

 WHEREAS, the submitted Plan was prepared pursuant to and in accordance with Title I of the National Affordable Housing Act of 1990, as amended, as well as the appropriate administrative rules and regulations promulgated and adopted under such Act; and

WHEREAS, additional reprogrammed and program income funds have been identified which increases the funding available in the Community Development Block Grant Fund; and

WHEREAS, in order to account for the actual funding that was allocated by HUD, the City must amend the One Year Action Plan; NOW, THEREFORE;

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:


Section 1. That additional revenue in the amount of $238,008.00 is estimated in the following accounts of the Community Development Block Grant Fund:

Grant 138,008.00

TOTAL $ 238,008.00

 

Section 2. That $1,181,950.00 is appropriated in the following accounts of the Community Development Block Grant Fund:

14-2600-575300-A-G57CDBG13 CDBG Administration 140,917.00

Section 3. That revenue is reduced in the amount of $4,890,138.00 in the following account of the HOME Investments Fund:

Section 4. That $3,135,159.00 is reduced from appropriations in the following accounts of the HOME Investments Fund:

Section 5. That revenue is reduced in the amount of $109,131.00 in the following account of the General Fund:

Section 6. That $109,131.00 is reduced from appropriations in the following accounts of the General Fund:

 

14-1000-575201-A-G57ESG13 Emergency Shelter Grant – HUD $ 5,431.00

14-1000-575201-B-G57ESG13 Emergency Shelter Grant – HUD 103,700.00

TOTAL $ 109,131.00

 

Section 7. That the Director of Neighborhoods and Housing Services is authorized to enter into contract amendments for the homeless prevention program to increase the reStart, Inc. contract by $74,206.00, for a total contract amount of $144,206.00, and the Sheffield Place contract by $29,494.00, for a total contract amount of $49,494.00, from funds appropriated to Account No 14-2600-575315-B-G57CDBG13.

 

Section 8. That Amendment No. 1 to the 2013 One Year Action Plan, prepared pursuant to the National Affordable Housing Act of 1990, as amended, a copy of which in substantial form is attached hereto, is hereby approved.

Section 9. That the Mayor, on behalf of the City of Kansas City, Missouri, is hereby authorized to execute and submit the aforesaid Amendment to the United States Department of Housing and Urban Development.

Section 10. That the City Council hereby certifies that said Amendment has been prepared and submitted to the U.S. Department of Housing and Urban Development pursuant to and in accordance with the Department’s rules and regulations, including but not limited to Title 24 Section 570.301 through and including 570.306 of the Code of Federal Regulations.
