SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 040994

 

Authorizing a contract up to $950,000.00 with the Industrial Development Authority of The City of Kansas City, Missouri for the demolition of the Seven Oaks Apartments in the Oak Pointe Planned Industrial Expansion Authority Area and recognizing an emergency.

 

WHEREAS, the Council finds that this ordinance is necessary for the immediate preservation of public peace, health and safety as the area requires immediate alteration to prevent crime and cure blight; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of City Development, on behalf of the City of Kansas City, Missouri, is hereby authorized to enter into and execute a up to $950,000.00 contract with the Industrial Development Authority of The City of Kansas City, Missouri, which is on file in the office of the Director of City Development and is incorporated herein by reference, for the purpose of providing activities for the demolition of the Seven Oaks Apartments in the Oak Pointe Planned Industrial Expansion Authority Area and related expenses from funds previously appropriated to the following account:

 

05-2940-552149-B Vineyard Multi-Family $950,000.00

 

Section 2. That the Council hereby states that the approval of this contract shall not be construed as conferring any development rights upon Oak Pointe Property, L.P. for the Oak Pointe Planned Industrial Expansion Authority Area.

 

Section 3. That this ordinance is recognized as an emergency measure within the provisions of Section 15, Article II of the Charter of Kansas City, and shall take effect in accordance with Section 15.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
