COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 101040

 

Estimating and appropriating $218,725.00 in the General Fund for health insurance rebate payments; authorizing the payment of certain health insurance rebates; and recognizing an emergency.

 

WHEREAS, the City of Kansas City received $2,855,413.00 in health insurance premium refunds for less than expected medical claims in FY 2009-10; and

 

WHEREAS, under the Collective Bargaining Agreement with Local 42, International Association of Fire Fighters, the City is required to remit to Fire Department employees, covered under the Collective Bargaining Agreement (“Covered Employees”), their share of any savings through health insurance premium refunds; and

 

WHEREAS, the percentage of the total refund attributable to current employees is 3.93%, an amount equal to $112,218.00, and to retired employees is 3.73%, an amount equal to $106,507.00; and

 

WHEREAS, in order to reduce the administrative expense to the City of processing these refunds to Covered Employees, it is recommended that one check be distributed to Local 42, I.A.F.F., with the Union handling the distribution to the Covered Employees; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That revenue in the amount of $218,725.00 is estimated in the following account:

 

11-1000-120000-485700 Medical Insurance Rebate $218,725.00

 

Section. 2. That $218,725.00 is appropriated from the Unappropriated Fund Balance of the General Fund to the following account:

 

11-1000-121602-B Health Insurance Rebate $218,725.00

 

Section 3. That the City Manager is authorized to process these health insurance rebate payments in accordance with the provisions of the Collective Bargaining Agreement with Local 42, I.A.F.F.

 

Section 4. That this ordinance is recognized as an emergency measure within the provisions of Section 503 of the City Charter in that it appropriates money, and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
